Consider approval or other action regarding additional expenditure of $48,000.00 to Klotz <br />Associates for engineering services for the preparation of plan/profile sheets for the sheet <br />flow relief swales and storm sewer outfall improvements in the Brookglen, Fairmont Park <br />East, Fairmont Park West and Creekmont Section One Subdivisions - T. Tietjens <br /> <br />I. Consider approval or other action regarding an Ordinance terminating the Main Street <br />Advisory Board - (Ord. 3278) - Mayor Rigby <br /> <br />Assistant City Attorney Clark Askins read the following ordinance captions: <br /> <br />Ordinance 3277 - AN ORDINANCE AMENDING CHAPTER 34 "ENVIRONMENT" OF <br />THE CODE OF ORDINANCES OF THE CITY OF LA PORTE BY AMENDING ARTICLE <br />IV. "UNSANITARY, UNSIGHTLY CONDITIONS ON PRIVATE PREMISES," SECTION 34- <br />128 "PROHIBITED CONDITIONS DESIGNATED", BY PROHIBITING NUISANCES ON <br />DEVELOPMENTS AND SUBDIVISIONS WITH AN APPROVED PLAT; PROVIDING A <br />REPEALING CLAUSE; CONTAINING A SEVERABILITY CLAUSE; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING THAT ANY PERSON <br />VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A <br />MISDMEANOR AND UPON CONVICTION SHALL BE FINDED IN A SUM NOT TO <br />EXCEED TWO THOUSAND DOLLARS; PROVIDING FOR THE PUBLICATION OF THE <br />CAPTION HEREOF; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />Motion was made by Councilmember Zemanek to approve Items A-H on the consent <br />aoenda as presented. Second by Councilmember Black. Motion carried unanimously. <br /> <br />Ayes: Engelken, Martin, Mosteit, Moser, Leonard, Zemanek, Black, and Mayor Rigby <br />Nays: None <br />Abstain: None <br />Absent: Clausen and Mosteit <br /> <br />Motion was made by Councilmember Moser to leave the Main Street Advisory Board in <br />place but it is to remain dormant at this time. Second by Councilmember Martin. Motion <br />carried unanimously. <br /> <br />Ayes: Engelken, Martin, Moser, Leonard, Zemanek, Black and Mayor Rigby. <br />Nays: None <br />Abstain: None <br />Absent: Clausen and Mosteit <br />
