<br />Fill Dirt Review Committee MtIles- July 10, 2003 <br />Page 2 <br /> <br />e <br /> <br />The Chairman announced the Committee would take Item 4 first on the agenda and conduct the <br />tour at 6:00 p.m. The Chairman announced there would be no discussion or action taken during <br />the tour. The Committee returned from the tour at 7:05 p.m. and reconvened the meeting. <br /> <br />5. DISCUSS AND REVIEW THE ACCEPTANCE FOR FILING AND THE ISSUANCE OF <br />PERMITS UNDER ORDINANCE 1444-A AND RESOLUTION 2003-19 THE <br />MORATORIUM REGARDING THE ACCEPTANCE FOR FILING AND THE <br />ISSUANCE OF PERMITS UNDER ORDINANCE 1444-A AND PROVIDE STAFF WITH <br />DIRECTION TO RESEARCH THE BACKGROUND ON THE CITY OF LA PORTE <br />DRAINAGE, mSTORY OF ORDINANCES, AND TESTIMONIES FROM THE <br />CITIZENS. <br /> <br />Chairperson Mike Mosteit asked the Committee for their comments. <br /> <br />Committee Member Chuck Engelken complimented staff on putting information together so <br />promptly, noting there was a high volume of permits. <br /> <br />Council member Bruce Meismer commented on the high volume of dirt being brought in. <br /> <br />Committee Member Beasley would like the Committee to act quickly concerning what is fair to <br />all citizens. When dirt is brought on property, measures need to be taken to protect neighbors <br />from flooding. Citizens obtaining permits should not be allowed to exceed the load amount <br />approved. <br /> <br />Councilmember Meismer voiced his concerns about property being raised and flooding other <br />citizen's property. Mr. Meismer does not want to see problems occur from using fill dirt; noting <br />we need to look at the entire City. <br /> <br />Committee Member Engelken is concerned about property on Lomax Drive; it appears that two <br />homes using fill dirt could cause their neighbors to flood. This problem is not unique to Lomax, <br />but to the entire City. The Committee needs more time to study the information provided by <br />Staff; requesting Staff to check the current contract; determining how much fill dirt is left. <br /> <br />Committee Member Beasley questioned staff on the status of follow-up on permits and a time <br />frame for follow-up. <br /> <br />City Manager Debra Feazelle stated this is a temporary situation and provisions need to be made <br />to ensure staff has time to inspect fill dirt permits. <br /> <br />Chairperson Mosteit noted this has been a long-standing problem. The Ordinance is not adequate <br />and suggested the following items be reviewed: <br />· Silting of drainage ditches <br />· City and County need to maintain drainage <br />· Monitor silting of ditches where fill dirt has been brought to the property <br />· Research timeline of how long it takes vegetation to grow on red clay dirt <br />· Once clay dirt has been researched, make recommendation to property owners <br />· Assess and research damage to roads from heavy trucks hauling fill dirt <br />· Assess whether or not trucks hauling fill dirt are allowed on streets <br />· Assess the adequacy of ditches <br />· Determine who is responsible for poor drainage in built up areas <br />
