L~ORTE AREA WATER AUTHORITY. <br />[~9INUTES <br />FEBRUARY 9, 1988 <br />1. The meeting was called to order at 6:05 P.M. by President, Jerry <br />Bramlett. <br />MEMBERS PRESENT: President Jerry Bramlett, Secretary Claude <br />Graves, Member Mike Wadsworth <br />MEMBERS ABSENT: Vice President Rick Matthews <br />OTHERS PRESENT: Bob Herrera, General Manager; Steve Gillett, <br />Public Works Director; Buddy Jacobs, Assistant Public Works <br />Director; Authority Attorney John Armstrong; Dale Conger of <br />Espey/Huston <br />2. The minutes of the meeting held on January 1g, 1988 were read. <br />Motion was made to approve minutes with noted changes by Claude <br />Graves and seconded by Mike Wadsworth. Motion was unanimous. <br />3. Invoice from Espey/Huston was discussed. Steve Gillett passed out <br />expenditure report and explained all the items. Claude Graves <br />asked for clarification of overbilling noted on current invoice. <br />Dale Conger was asked by Bob Herrera to check and get back with an <br />explanation. Motion was made by Claude Graves and seconded by <br />Mike Wadsworth to pay invoice and request written clarification <br />from Espey/Huston for overbilling. Motion was unanimous. <br />~4. Annexation Petition of Bay MUD was discussed. Bob Herrera turned <br />over to John Armstrong to discuss attorney opinions. John <br />Armstrong discussed petition requirements. He stated the form of <br />the petition is appropriate. Petition has 51 signatures <br />(needs 50). The Board needs to certify the petition. The <br />annexation hearing must be held within 30 days of certification. <br />Requirements of hearing were discussed. John Armstrong stated <br />area to be annexed must be contiguous to boundaries. Bay h1UD is <br />two (2) separate sections split by Shoreacres. Claude Graves <br />questioned as to the possibi]_ity of contiguous meaning touching in <br />one area. Bay MUD is a single entity. John Armstrong is to check <br />on legality of this idea. <br />
