• <br />Page Two <br />Minutes <br />February 9, 1988 <br />The Board directed John Armstrong to contact the Texas Water <br />Commission by telephone for an opinion on annexation legality. <br />Bob Herrera and John Armstrong to get back with Bay MUD and <br />explain that the legal aspects of annexation is being <br />investigated. Claude Graves asked about the make-up of the Board <br />if Bay N1UD is annexed. Bob Herrera stated Bay MUD would be able <br />to submit a nomination for one (1) additional Board Member to the <br />La Porte City Council.. <br />Motion was made by Claude Graves to investigate annexation <br />procedures and report back to the Board on March 8, 1988. <br />Seconded by Mike Wadsworth. Motion was unanimous. <br />5. Dale Conger reported the Design Engineering Report was complete. <br />He gave an update on present work being done. He expressed the <br />need for aerial survey of new Bay MUD route. Dale also <br />recommended adding aerial survey and asked the Board for <br />direction. Claude Graves asked if extra cost can be passed to Bay <br />MUD. Bob Herrera stated the possibility will be investigated. <br />Dale Conger reported that City staff is still working on obtaining <br />permission from Harris County Flood Control P.istrict to use Big <br />Island Slough and an easement from PPG along Bay Area Blvd. <br />6. Bob Herrera reported on two (2) phone calls to Sam Dixon of <br />Coastal Water Authority. Bob Herrera intends to visit Sam Dixon <br />on right-of-way acquisition and to continue building <br />relationships. Also Bob Herrera reported one the meeting with the <br />Harris County Flood Control District about the use of Big Island <br />Slough right-of-way. He indicated the Harris County Flood Control <br />District had denied the Authority~s request for use of the <br />right-of-way. An appeal to Mr. Green of the Harris County Flood <br />Control District will be made on the denial. <br />Bob Herrera requested the Directors execute the Bonds For <br />Liability he distributed. This Bond is for liability protection <br />of the Directors. <br />
