• <br />Page Three <br />Minutes <br />May 9, 1989 <br />Steve Gillett reported Mercer Construction Company has provided <br />the Authority with an updated construction schedule. He stated <br />there is a progress meeting with the contractor the last Thursday <br />of every month at 1:30 P.M. at Public Works where the contractor <br />presents estimates and problems he is encountering. The minutes <br />of these meetings are mailed with each Authority meeting agenda. <br />Mr. Gillett also reported he talks with Robert Ray daily and <br />receives written daily reports weekly that he plots and notes the <br />progress of the water line. <br />7. General Manager Bob Herrera reported on the following easements: <br />The easement between Fairmont Park Joint Venture and the City <br />of La Porte on behalf of the Authority has been agreed on and <br />a check has been issued. In addition, a deed has been filed <br />in Harris County. <br />The Authority"s attorneys and attorneys representing Height <br />Savings and the FSLIC reached a verbal agreement on location <br />of the Shoreacres" easement and are in the process of <br />acquiring a written agreement. FSLIC has agreed to allow the <br />contractor right of entry in the event problems arise. <br />John Joerns has visited with PPG"s plant manager and has had <br />contact with the attorney representing PPG and feel a license <br />agreement is forthcoming. Again, if the La Porte Area Water <br />Authority is put under undue circumstances to meet a <br />completion deadline, PPG will give the Authority right of <br />entry. <br />As directed by the Board, a letter was written to Cody Greer, <br />Real Estate Attorney for the City of Houston and Coastal <br />Water Authority (CWA), copied to the Subsidence District and <br />Jon Vanden Bosch. Mr. Greer has reviewed the agreement <br />drawn up by LPAWA attorneys, making minor changes. This <br />agreement has now been sent to Friendswood Development <br />Company and should receive their approval. Friendswood may <br />ask for some attachments asking the Authority for permission <br />to enter the easements if needed in the future. <br />Steve Gillett restated the project schedule noting the Authority <br />still had some time to procure the easements before the Contractor <br />needs entry. <br />8. President Jerry Bramlett thanked the General Manager for his quick <br />action on the letter sent to Cody Greer. <br />
