• • <br />Called Meeting - 8/5/74 - Continued 3 <br />• <br />Mayor Thomas located the property in question on the map <br />showing the city limit line as the west boundary, the <br />railroad on the north, Lomax School Road on the south and <br />Highway 225 on the east. <br />Mayor Thomas asked if there was anyone opposed to the <br />rezoning that would like to speak. There being none, <br />he asked if there was anyone to speak in favor of the <br />rezoning. <br />Mr. Elmer D. Barker was recognized. Mr. Barker stated <br />that he was also representing his sister, who was unable <br />to attend the hearing. Mr. Barker stated that this <br />property was just at the edge of La Porte and was <br />surrounded almost entirely by commercial property. On <br />the north is the railroad, which is Southern Pacific which <br />has land between there and 225; on the west is being used <br />for commercial property, you can see junk cars, which is <br />adjoining property with his. On the other side is one <br />acre which the Coastal Industrial Water Authority has <br />bought and plan to use this for their headquarters when <br />they start to lay their pipeline and will have all their <br />construction equipment in there. Across the road is <br />pasture land. He thanked the Commission for the opportunity <br />• to speak. <br />Mayor Thomas explained to Mr. Barker that when an area <br />is annexed by La Porte, it automatically becomes R-1, <br />Residential. According to the zoning rules, the Planning <br />and Zoning Commission is suppose to go back and rezone <br />the newly annexed property to proper use. This would <br />include the Barker property and surrounding property. <br />He further stated that he was sorry that this had not <br />been done. At the present time, the City has an <br />ordinance that has a fee for rezoning. Mayor Thomas <br />stated that he and Mr. Roberson of the Planning and <br />Zoning Commission had discussed the matter and were <br />planning a work shop with the Commission and the <br />Planning and Zoning Commission to make revisions down <br />through the whole area. If the Commission was in <br />accord, after the revisions were made, he hoped to be <br />able to reimburse a portion of the rezoning fee. <br />Mayor Thomas further stated newly annexed property <br />owners were victims of circumstance and should not be <br />penalized for rezoning. But if after the first zoning <br />change, property owners would have to pay the fee. <br /> Mr. Walter Roberson, Chairman of the Planning and <br />• Zoning Commission was recognized and stated that a <br />
