Mr. McDuff reassured the Commission that that <br />entrance has been changed and the only entrances to the parking lot <br />will only be on $th Street. <br />Public Hearing was closed at 7:15 P.M. <br />There was a motion by Jack Gresham and a second by Janet Graves to <br />approve the minutes from the Regular Meeting of February 11, 1988. The <br />vote was unanimous and the minutes were approved as read. <br />Next item was to consider recommendation to be presented to City <br />Council regarding the Special Conditional Use Permit for Lots 25-32 of <br />Block 149; La Porte Tract. <br />Staff's report indicates there were 18 notices sent to the surrounding <br />properties owners within 200 feet, as is required. There were three <br />(3) replies, all in opposition. Two (2) of them were concerned with <br />dust control and one (1) requesting his own property be rezoned. <br />The Eagles request meets all prerequisite conditions necessary for the <br />issuance of this Special Conditional Use Permit with the following <br />conditions: <br />1) Parking surface, including existing on site parking, must be <br />surfaced to control dust as per Section 10-605(7). Surfacing <br />must be approved by the Director of Community Development. <br />2) Parking surface must be setback 25 feet from the front property <br />and 10 feet from the exterior side property line as per Section <br />10-607(5). <br />3) The 7th Street and "G" Street face of the lot must be screened from <br />public view as per Section 10-605(11.). The screening plan must be <br />approved by the Director of Community Development. <br />4) Any surfacing of the alley of Block 149 must be approved in advance <br />by the Director of Public Works. <br />5) The final suggested condition is that no parking lot entrances be <br />allowed onto 7th Street. <br />6) The alley will not be used for primary access to the parking lot. <br />7) A Release to be prepared by the Fraternal Order of the Eagles <br />stating that the City of La Porte will not be held responsible <br />for any repairs to the paved surface of the alley should the City <br />need to repair any utilities located therein. The Fraternal Order <br />of the Eagles will also hold the City harmless of any injuries <br />occurring on said alley. This letter must be acceptable to the <br />City of La Porte Attorney's Office. <br />
