<br />~ <br /> <br />,.. <br /> <br />Supplement <br /> <br />Page 4 <br /> <br />Section 10-900 Tree Preservation (pgs. 88,89): <br /> <br />Staff ~ould suggest amending the <br />paragraph of this section as follo~s: <br /> <br />"Prohibited Conduct" <br /> <br />It shall be unla~ful for a person to cause or permit <br />the destruction of any native tree which is located <br />within fifteen(15) feet of any street right of ~ay line <br />Q!___~~_?e!llent Line abutting the required front yard or <br />~ithin ten(10) feet of any street right of ~ay line <br />~~.::i.e__E:Il1~~t li~e abutting a required side yard... <br /> <br />This amendment ~ould constitute a minor <br />scope of this provision. Although <br />this section tracks the requirements of state la~, the ordinance <br />~ording is some~hat confusing. For purposes of clarification, <br />staff ~ould suggest the follo~ing ~ording: <br /> <br />In case of a protest against any such amendment, <br />change or repeal o~ the reg~lations, restrictions and <br />herein established, a wri:te~ protest, fi:ed with the <br />officer and signed bv the owners of at least twenty <br />of either: <br /> <br />supplement, <br />boundaries <br /> <br />enrorcerr,E.i-lt <br /> <br />percent (2096) <br />
