<br />page 4 of 5 <br /> <br />The building location noted does not meet the setback <br />requirements of Section 6-500, Table B. The setback requirements <br />are Front; 20 feet; Rear; 10 feet; side (adjacent to R-O-W); 10 <br />feet. Under the provisions of Zoning Ordinance Section 3-100, <br />this tract is considered to be a "through lot" with both the <br />Broadway and San Jacinto Street faces subject to front setback <br />requirements. Exhibit C indicates the building relocated to a <br />point which complies with minimum setback requirements. This <br />location is noted as an illustration of minimum setback and not <br />as a specific required building location. <br /> <br />Section 10-605 specifies that commercial driveway width be <br />between twenty and twenty five feet. The gate and fencing <br />proposed by the applicant appear to satisfy this requirement. <br /> <br />Regarding the general conditions established by Section 10- <br /> <br />202: <br /> <br />1) That the specific use will be compatible with and <br />not injurious to the use and enjoyment of other <br />property... <br /> <br />The determination of whether the request satisfies this <br />condition must be made by the Commission (and in turn City <br />Council) based upon input from the applicant, citizen comment and <br />their knowledge of the Zoning Ordinance and the Comprehensive <br />Plan. <br /> <br />2) That the conditions placed on such use...have been <br />met by the applicant. <br /> <br />As presently proposed by the applicant <br />are aspects of the facility which would not <br />requirements. So long as the applicant is <br />required changes, the facility can be made <br />applicable requirements. <br /> <br />(Exhibit B), there <br />meet Zoning Ordinance <br />willing to make the <br />to conform with all <br /> <br />3) <br /> <br />That the applicant has agreed to <br />additional conditions proposed... <br /> <br />meet any <br /> <br />Should this request be granted, the applicant must submit <br />for review and approval a Certified Site Plan and Building Permit <br />application. Approval of both is required before the facility <br />can be developed. These approvals are contingent on compliance <br />with all applicable conditions and City Ordinance requirements. <br />
