<br />Page 2 of 3 <br />Staff Report 12/11/91 <br />Bay Green Colony <br /> <br />* <br /> <br />12/91 <br /> <br />Developer response to 12/3/91 letter; submittal <br />of Deed Restrictions and applicable covenants <br />12/9/91, plat and plans/specifications: also <br />attached letter requesting variance approval for <br />change made at the entrance to the subdivision. <br /> <br />Staff reviewed submittals of the following: <br /> <br />* <br /> <br />12/10/91 <br /> <br />* <br /> <br />Plat, construction plans and specifications <br /> <br />* <br /> <br />Variance request (see attached letter dated 12-6-91) <br /> <br />* <br /> <br />Covenants and restrictions <br /> <br />After review, staff offers the following information: <br /> <br />* <br /> <br />Staff offers no particular objection to the variance request dated <br />December 6, 1991. <br /> <br />* <br /> <br />The Developer still needs to obtain a variance from the La Porte <br />Board of Adjustments for the proposed common drive locations. <br />(See letter dated 3-6-91) <br /> <br />* <br /> <br />A review of the covenants and restrictions revealed areas of conflict <br />with both the subdivision plat and City Ordinances. We will visit with <br />the Developer as soon as possible to discuss and resolve these <br />issues. <br /> <br />When considering final plat approval the Planning & Zoning Commission may, per the <br />Development Ordinance No. 1444 within thirty (30) calendar days of the filing date, take <br />one of the following actions: <br /> <br />1) Approve the Final Plat as filed; <br /> <br />2) Disapprove the Final Plat as filed, provided the reasons for such <br />disapproval are stated in writing and a copy of the statements is <br />signed by the Chairman of the Planning Commission. <br /> <br />Commission action shall be noted on three (3) copies of the Final <br />Plat, which shall be distributed to the developer, Department, and <br />official files of the Commission. <br />
