CALL PUBLIC HEARING TO ORDER <br />SPECIAL CONDITIONAL USE PERMIT REQUEST #SCU92-001 WHICH IS <br />REQUESTED FOR LOTS 36-47; BLOCK 3; BATTLEGROUND ESTATES <br />SECTION I. THE PURPOSE OF THE REQUESTED PERMIT IS TO ALLOW <br />THE ABOVE DESCRIBED PROPERTY TO BE USED FOR AGRICULTURAL <br />PURPOSES, RAISING LIVESTOCK. <br />Chairman Waters called the Public Hearing to order at 6:08 P.M. <br />Mr. Harrington briefed the Commission regarding SCU92-001. The applicants, <br />Ronnie and Melody Elledge own the property located in the 11000 Block of <br />Monument Road (Lots 36-47; Block 3; Battleground Estates, Section I). They are <br />proposing to utilize this property for raising livestock for their children's 4-H and <br />F.F.A. projects. The proposed improvements would consist of a barn and fencing. <br />This request satisfies ordinance prerequisites and is eligible for the requested Special <br />• Conditional Use Permit, therefore, staff recommends approval of the request, subject <br />to the following conditions: <br />I. Fencing shall be setback at least 25 feet from side property lines. <br />II. A maximum of two (2) head of livestock shall be housed on this <br />property at any time. <br />III. No animal which could be classified as wild or dangerous under the <br />provisions of Ordinance 1401 shall be housed on this property at any <br />time. <br />Twenty-two (22) notices were mailed to adjacent property owners. Eight (8) were <br />returned in favor of the request, and three (3) were returned in opposition to the <br />request. Two (2) were returned undeliverable. <br />Mr. Lewis stated that staff had not found anything in the subdivision's deed <br />restrictions which would preclude this activity. <br />Mr. Ebow expressed concern for the adjacent property owners who may not desire <br />this type of activity in their subdivision. Mr. Harrington stated that the Northwest <br />• part of La Porte is typically a rural area and that a number of the people who live <br />there do so to have the opportunity to raise livestock.
