Section 5.02 of the Development Ordinance requires construction of <br />sidewalks within a subdivision when required by the Comprehensive <br />Plan or by the Planning Commission. As no facilities are required by <br />the Comprehensive and there are no sidewalks in the area, the staff <br />recommends waiver of this requirement. <br />X. Section 11.04 of the Development Ordinance requires installation of <br />street lighting within new subdivisions. Iin view of the the rural nature <br />of this proposed subdivision, Staff is reviewing the requirement for <br />possible waiver. Staff proposes to ~ bring back additional information <br />prior to the final plat including recommendations for a policy in rural <br />areas. <br />XI. Appendix D of the Development Ordinance requires building <br />lines to be shown on the plat. <br />• Conclusion: <br />The Denim & Diamonds subdivision, as proposed, is in substantial compliance with <br />applicable City Ordinances. Staff, therefore, recommends granting conditional approval to <br />this preliminary plat. <br />PRELIMINARY PLAT: ACTION BY THE APPROVING AUTHORITY <br />All Preliminary Plats require final approval from the Commission. Following review of the <br />Preliminary Plat, the Commission shall, within thirty (30) calendar days of the filing date, <br />take one of the following actions: <br />1. Approve the Preliminary Plat as filed; <br />2. Conditionallx,approve the Preliminary Plat as filed, provided, the reasons are <br />stated in writing and a copy of the statement is signed by the Chairman of the <br />Planning Commission. <br />3. Disapprove the Preliminary Plat as filed, provided, the reason for such <br />disapproval are stated in writing and a copy of the statement is signed by the <br />Chairman of the Planning Commission. <br />• <br />
