These plans have been approved. <br />7) Residential Pazkland: Lot 1 is anticipated (on plat document) for commercial <br />development. Lot 2 will contain 104 dwelling units. Section 12.00 of the <br />Development Ordinance requires either dedication of pazkland or money paid <br />to the City in lieu of pazkland. <br />Section 12.03 requires that for developments comprised of 160 units or less, <br />there shall be a payment of money rather than land dedication. Payment is <br />to be made at the rate of $175 per dwelling unit (Section 1205.B). The total <br />amount due for this development is $18,200. This money is to be placed in <br />an escrow account and may only be expended to cover the cost of acquisition <br />or improvement of pazk facilities. The facilities must be located in the same <br />pazk zone as the development. College View is in Pazk Zone # 1, which is <br />located between Spencer Hwy. and Fairmont Pkwy. It extends from <br />• Underwood Rd., west to the City limits. The plat may be approved by the <br />Commission, but not released for recordation prior to payment of these fees. <br />8) Conditional Approval Document: The City of La Porte is very concerned <br />with the issue of stormwater drainage. The City, under the terms of the <br />Development Ordinance, requires new development to comply with the <br />stormwater drainage plan administered by Hams County Flood Control. <br />The applicants have submitted to the City, a letter from Harris County Flood <br />Control establishing allowable design pazameters for retention and dischazge <br />of stormwater. The applicants have also submitted to the City, a stormwater <br />plan based upon and complying with the County's specifications. A copy of <br />the Harris County letter is attached and follows this report. <br />In addition to checklist items, staffs review included the following: <br />Covenants: Development Ordinance, Section 4.04 also requires submittal of <br />subdivision covenants, restrictions, conditions, and reservations <br />affecting property within the Final Plat. The covenants aze to include <br />provisions chaztering a property owner's association. The association <br />is to have charge of maintenance of common azeas, compensating open <br />space, private streets and alleys. The association is to be empowered <br />• to assess dues that aze to be used to enforce deed restrictions and <br />maintain common areas, streets, etc. <br />
