Industrial Gases • • <br />SCU 99-002 <br />Page 2 of 2 <br />Staff would note that the site in question is surrounded on all sides by <br />a Light Industrial Zone (Exhibit B). The said building is surrounded by <br />Anthony Crane Rentals on the west, warehouses on the south and east, and a <br />heavy wooded area on the north. The City's Comprehensive Plan addresses <br />the following issues pertaining to the manufacturing, assembly, and <br />warehousing within an Industrial Zone. <br />Should be targeted in selected industrial areas. <br />Should have good access to truck routes, hazardous material mutes & <br />railroads. <br />Should not be directly adjacent to residential areas. <br />Should have good access to secondary and primary streets. <br />With this in mind, it may be necessary to evaluate the character of the <br />surrounding and adjacent areas. It is important to carefully consider the <br />extent to which the existing use of the property may harm the value of the <br />adjacent property such as excessive air pollution, water pollution, noise <br />pollution, or other environmental issues. <br />Given the nature and extent of industrial development in and around La <br />Porte, the potential for a fire or explosion is a real risk to the community and <br />its residents. Although, regulatory safeguards and industry initiatives help to <br />reduce this risk but safety measures are necessary for safe operation of these <br />businesses. However, the applicant has recognized the need for public safety <br />and has constructed a two-hour firewall between this business and adjoining <br />tenants, as requested by the Fire Marshal. <br />Staff has found the request satisfies all applicable ordinance requirements. It <br />is compatible with the goals and objectives of the Comprehensive Plan. <br />Furthemiore, the facility is compatible with the surrounding properties and <br />should not be injurious to the use, enjoyment or value of surrounding <br />properties. <br />Condusion: Based on the facts and considerations presented above, staff <br />recommends granting Special Conditional Use Permit #SCU99-002 subject <br />to the following conditions: <br />A minor development site plan, prepared in accordance with the <br />requirements of Development Ordinance 1444, shall be submitted for <br />review and approval by the City. <br />EPA permit complying with refrigerant recycling rules under Section <br />608 of the Clean Air Act, 1990 shall be finnished to the City. <br />Landscaping of parking lot shall be required. <br />The applicant shall pay the cost of public hearing. <br />
