The General Plan will not be in effect until formal approval of the Special <br />Conditional Use Permit has been granted by City Council. <br />2. A Minor Development Site Plan shall be submitted to the City in <br />accordance with the requirements of Ordinance #1444 and conditions <br />attached to the special conditional use permit. <br />Motion seconded by Dottie Kaminski. All were in favor and the motion passed. <br />X. CONSIDER FINAL PLAT OF BAYPORT NORTH INDUSTRIAL PARK TO BE <br />LOCATED IN THE BAYPORT INDUSTRIAL DISTRICT OF LA PORTE. <br />Staffs report presented by Mr. Malik. Bob Klassen, of Sunbelt Commercial <br />Builders, has made application for a Final Plat of the proposed Bayport North <br />Industrial Park to be located on Underwood Road at Fairmont Parkway. <br />Mr. Klassen gave a brief presentation and answered questions from the <br />Commission. <br />Staff recommended approval of the request. <br />Motion by Sandie Staniszewski to approve the Final Plat of Bayport North <br />Industrial Park in accordance with the following: <br />1. City of La Porte City limit line shall be shown on the plat. <br />2. Statement shall be shown on the plat stating that public or private streets <br />shall be developed and maintained as per laws of Hams County and the <br />City of La Porte shall not be responsible for their maintenance <br />3. Deed restrictions shall be made available for review by the City Attorney. <br />Motion seconded by Dottie Kaminski. All were in favor and the motion passed. <br />XI. PRESENTATION BY THE DEVELOPER OF THE BAYOU FOREST <br />APARTMENTS PROJECT PROPOSED AT THE CORNER OF STATE <br />HIGHWAY 146 AND McCABE ROAD. <br />Mr. Malik presented staff's report. The Commission previously approved a 176 <br />unit apartment complex on ten acres of land at the comer of Hwy. 146 and <br />McCabe Road. The Developer, Mr. Eddie Dutko, has submitted a new General <br />Plan. The new plan has significant changes including 65 acres of wetlands that <br />will be donated to the City for a park. <br />Mr. Dutko gave a brief presentation and answered questions. The Commission <br />was receptive to this latest plan and gave Mr. Dutko a favorable recommendation <br />to proceed with formal submittals for Phase I. If approved for construction, any <br />impacts on the community from Phase I will be taken into consideration if and <br />when future phases are requested. <br />
