A <br />1. CALL TO ORDER <br />Meeting called to order by Chairperson Waters at 6:00 P.M. <br />2. APPROVE MINUTES OF THE JULY 15, 2004, REGULAR MEETING & PUBLIC HEARING. <br />Motion by Doretta Finch to approve the Minutes of July 15, 2004. Second by Paul Berner. The motion <br />carried. <br />Ayes: Finch, Berner, Kaminski, Barrera, Linscomb, Lawler, and Waters <br />Nays: None <br />Abstain: None <br />3. CONDUCT- PUBLIC HEARING AND CONSIDER RECOMMENDATION TO CITY COUNCIL.;..=: <br />' EGARDINO REZONE REQUEST #R04-008 FOR 1.75 ACRES OF LAND LOCATED IN THE 9700 <br />BLOCK OF SPENCER. HIGHWAY, FURTHER DESCRIBED AS TRS 11A AND 11B, BLOCK3; W.J... <br />-PAYNE SUBDIVISION,.W.M. JONES SURVEY, A-482, LA PORTE, HARRIS COUNTY, TEXAS.:TH.E, <br />CITY OF LA PORTE SEEKS TO REZONE THE PROPERTY FROM LOW DENSITY RESIDENTIAL <br />(R-1) TO GENERAL COMMERCIAL (GC) FOR AN EXISTING COMMERCIAL STRIP INCLUDING�A <br />PROPOSED SITE FOR FIRE STATION NO. 2 TO BE LOCATED AT 9710 SPENCER HIGHWAY. ' <br />Chairperson Waters opened the public hearing at 6:00 P.M. <br />Planning Coordinator, Masood Malik, outlined the material presented to the Commission. Staffs review <br />of the Zoning. Map revealed an existing commercial strip site at the southeast corner of Spencer <br />Highway and Underwood Road zoned Low -Density Residential (R-1), however commercial <br />establishments have been operating at the site for several years as pre-existing and non -conforming. <br />The City plans to build a new Fire Station (#2) adjacent to this site, at 9710 Spencer Hwy. The <br />requested rezone would include the fire station site and would also bring the existing non -conforming <br />commercial strip into a more conforming use. <br />There were no comments from the audience. <br />Chairperson Waters closed the public hearing at 6:05 P.M. <br />Motion by Paul Berner to recommend to City Council, approval of Rezone Request #R04-008 for 1.75 <br />acres of land located in the 9700 Block of Spencer Highway from Low -Density Residential (R-1) to <br />General Commercial (GC). Second by Kirby Linscomb, Jr. The motion carried. <br />Ayes: Berner, Linscomb, Barrera, Kaminski, Finch, Lawler, and Waters <br />Nays: None <br />Abstain: None <br />
