OPEN PUBLIC HEARING TO RECEIVE CITIZEN INPUT ON A PROPOSED AMENDMENT TO <br />CHAPTER 106 OF THE CODE OF ORDINANCES BY AMENDING SECTION 106-521, TABLE <br />A, "INDUSTRIAL USES", REGARDING TRUCKING TERMINALS IN LIGHT INDUSTRIAL (LI) <br />AND HEAVY INDUSTRIAL (HI) ZONING DISTRICTS WHEN LOCATED ON AUTHORIZED <br />TRUCK ROUTES WITHIN THE CITY LIMITS OF LA PORTE. <br />A. STAFF PRESENTATION <br />Staff's Report was presented by Mr. Malik. The amendment to Chapter 106 of the Code <br />of Ordinance was presented as a workshop item at the August 25, 2008 City Council <br />meeting. The Planning and Zoning Commission held a workshop at the November 20, <br />2008 meeting. <br />The consensus of the Commission after the November 20, 2008, meeting was to <br />change the language to make is clear that trucking terminals should be allowed only in <br />light industrial and heavy industrial zoning districts and should be further restricted to <br />locations directly adjacent to authorized truck routes. <br />B. PROPONENTS <br />There were no proponents. <br />C. OPPONENTS <br />There were no opponents. <br />11. CLOSE PUBLIC HEARING. <br />Chairman Lawler closed the public hearing at 6:03 p.m. <br />12. CONSIDER RECOMMENDATION TO CITY COUNCIL REGARDING A PROPOSED <br />AMENDMENT TO CHAPTER 106 OF THE CODE OF ORDINANCES BY AMENDING <br />SECTION 106-521, TABLE A, "INDUSTRIAL USES", REGARDING TRUCKING TERMINALS <br />IN LIGHT INDUSTRIAL (LI) AND HEAVY INDUSTRIAL (HI) ZONING DISTRICTS WHEN <br />LOCATED ON AUTHORIZED TRUCK ROUTES WITHIN THE CITY LIMITS OF LA PORTE. <br />After an in-depth discussion, the Commission agreed to write a letter to City Council suggesting <br />the review of truck routes (Traffic and Vehicle Ordinance). <br />Motion by Nick Barrera to recommend to City Council to approve an amendment to Chapter <br />106 of the Code of Ordinance follows: <br />Add footnote 'J' to Section 106-521, Table A, Industrial Uses, Footnotes. <br />Trucking terminals — See Section 106-746 of this Chapter for additional requirements. <br />"J. Trucking Terminals. Trucking terminals shall be allowed only in Light Industrial (LI) <br />and Heavy Industrial (HI) zoning districts and shall be further restricted to locations <br />directly adjacent to the right of way (as same are designated in Section 70-231 of this <br />Code) located in said LI and HI zoning districts. Any truck terminal operating in whole or <br />in part as a container yard or converting to a container yard shall be restricted to Heavy <br />Industrial (HI) zone only. See Section 106-746 of this Chapter for additional <br />requirements." <br />
