<br />#R 08-003 <br />P&Z 3/19/09 <br />Page 3 of3 <br /> <br />Conclusion! <br />Recommendation: <br /> <br />Utilities - Currently, the site has sufficient water and sewer facilities to serve this <br />development. It will be the applicant's responsibility to provide any structures or <br />improvements necessary to accommodate increased demand of water and sanitary sewer for <br />future development. Fire protection and storm water management are potential issues, which <br />should be carefully reviewed with a site development plan. Additional fire hydrants would <br />be required. In addition, on-site detention may be required depending on the design criteria <br />for the FIOI system and proposed development site plan. <br /> <br />Based on the above analysis, staff fmds the requested change is compatible with the zoning <br />and uses of nearby properties. The tract in question is suitable for the requested change to <br />PUD with an underlying land use of commercial/industrial. Development within the subject <br />tract should not negatively impact the surrounding properties and should not harm the value <br />of nearby properties. It would not have a significant impact on traffic conditions in the area <br />and utilities would not be affected. <br /> <br />In reviewing this request the Commission should consider the following points: <br /> <br />. There was no apparent error in assigning the present zoning designation to the tract <br />in question. <br />. The applicant's requested zoning provides some flexibility for the developer while at <br />the same time allowing the City to review specific uses subject to Special <br />Conditional Use Permit and site layouts at the various stages of the development. <br /> <br />Staff recommends approval of the rezone request with an understanding that any further <br />development shall require SCUP to be approved by the City. <br /> <br />Options available to the Commission are: <br /> <br />. Recommend to Council approval of this rezoning request from BI to PUD. <br />. Recommend to Council denial of this rezoning request from BI to PUD. <br />. Table this item for further consideration by the Commission. <br />
