<br />Planning and Zoning Commission <br />Minutes of March 19,2009 <br /> <br />Members Present: <br /> <br />Hal Lawler, Dottie Kaminski, Nick Barrera, Doretta Finch, Kirby Linscomb Jr., <br />Paul Berner, and David Janda (Alt 1). <br /> <br />Members Absent: <br /> <br />Les Bird and Lou Ann Martin (Alt 2). <br /> <br />City Staff Present: <br /> <br />Planning Director, Tim Tietjens; City Planner, Masood Malik; Assistant City <br />Attorney, Clark Askins; and Planning Assistant, Shannon Green. <br /> <br />Others Present: <br /> <br />1. Call to Order. <br />Meeting called to order by Chairman Lawler at 6:05 p.m. <br /> <br />Chairman Lawler noted Commissioner Les Bird was absent and David Janda (All. 1) would be a <br />voting member. <br /> <br />2. Consider Approval of the February 19, 2009, Regular Meeting and March 05, 2009, Special <br />Called Meeting Minutes. <br /> <br />David Janda recommended changes to the Minutes. <br /> <br />Motion by Paul Berner to approve the Minutes of February 19, 2009, and March 5, 2009 with the <br />following corrections: <br /> <br />February 19, 2009 <br />· Item 6.A, paragraph 4.- correct spelling of "beautification" <br />· Item 6.C, paragraph 3 - correct spelling of "boundary" <br />· Item 8, - Delete last sentence of first paragraph: "David Janda made a competing <br />motion to add the residency or business owner of the design professional and <br />arch itecl." <br />Add: David Janda commented that the Architect/Landscape Architect and Design <br />Professional, as members of the Design Assistance Review Team, be La Porte <br />business owners or residents of La Porte. <br /> <br />March 5, 2009 <br />. Item 3 - remove Lou Ann Martin from "Ayes". <br /> <br />Second by Dottie Kaminski. The motion carried. <br /> <br />Ayes: <br /> <br />Hal Lawler, Dottie Kaminski, Nick Barrera, Doretta Finch, Kirby Linscomb, Jr. <br />Paul Berner, and David Janda (Alt 1), <br />None <br />None <br /> <br />Nays: <br />Abstain: <br /> <br />David Janda asked if Chairman Lawler had filed a conflict of interest affidavit in conjunction with <br />the public hearing item associated with Item #3. Chairman Lawler confirmed he had filed an <br />affidavit that afternoon. <br /> <br />Chairman Lawler left the room and Vice Chairperson Dottie Kaminski chaired the meeting. <br /> <br />3. Open public hearing to receive citizen input on Rezone Request #R08-003 for approximately 14 <br />acres of land located at 1400 North 10th Street, further described as TR 27 of Block 27, TR 28 of <br />Block 28, Nebraska Syndicate and TR 3 in the Enoch Brinson Survey, Abstract 5, Volume 65, <br />Page 175, H.C.D.R., La Porte, Harris County, Texas. Troulon Realty Ltd., & Oak Park, LLC. seek to <br />rezone the property from Business Industrial (BI) to Planned Unit Development (PUD). <br />
