Open public hearing to receive citizen input on Special Conditional Use Permit #SCU09- <br />002 for property located along McCabe Road and State Highway 146, further described as <br />107:1: acre tract in the W.P. Harris Survey, Abstract 30; La Porte, Harris County, Texas. <br />Eddie Dutko, General Partner, Land Holding Corporation, seeks approval of Special <br />Conditional Use Permit for development of the Preserve at Taylor Bayou within a Planned <br />Unit Development (PUD) zone. <br />Chairman Lawler opened the public hearing at 7:43 p.m. <br /> <br />Motion by Dottie Kaminski to table both the public hearing and the recommendation to City Council <br />regarding Special Conditional Use Permit #SCU09-002 for property located along McCabe Road <br />and State Highway 146, as shown in Item 9. Second by Paul Berner. Consider recommendation to City Council regarding Special Conditional Use Permit <br />#SCU09-002 for property located along McCabe Road and State Highway 146. <br />Tabled. See action taken on item #7. <br /> <br />10. Open Workshop to discuss the following provisions: <br />A. Site Plan Expiration. <br />Staff has noticed that several site plans have been approved but applications for permits have <br />not been filed with the City. Due to changes in codes and other pertinent laws or ordinances of <br />the City, the development conditions and circumstances may not be the same as at the time of <br />the site plan approval. Staff suggested a time limitation or validity of site plan approval for a <br />period of 1-year. After expiration, the site plan approval would be deemed void and the <br />developer would need to submit a new certified site plan for the proposed development. <br /> <br />The Commission agreed there should be a one-year limit placed on site plan approvals. <br /> <br />B. Sexually Oriented Businesses <br />Masood Malik gave staffs report. Staff has reviewed Chapter 90 of the Code of Ordinances <br />and the material received at the APA Conference in February. Staff believes there is sufficient <br />enforcement of Sexually Oriented Businesses through Chapter 90. Staff analyzed the <br />provisions of Chapter 106 (the Zoning Ordinance) and found that footnote (G) is incorrect as it <br />guides to provision "Noise" which is irrelevant, Footnote (G) should be corrected to show "g", <br />which determines the location of adult oriented businesses. <br /> <br />After a discussion by Staff and Commission members, Clark Askins, City Attorney <br />recommended Staff bring the item back for a workshop. Mr. Askins asked staff to include a <br />draft remodel of the ordinance and materials as back up for the workshop. <br /> <br />The Commission agreed to workshop an amendment for Sexually Oriented Businesses. <br />
