<br />CITY OF LA PORTE <br />INTER-OFFICE MEMO <br />T0: BOB SPEAKE <br />FROM: DULISSEN <br />DATE: 5/1/85 <br />SUBJECT: APPEAL-VALCON II, INC. <br />The City has received an appeal from the decision of the Building <br />Official concerning the placement of a travel trailer for living <br />purposes on the site for the new Lomax Junior High School. <br />HISTORY: <br />Section 13-405(2) of the Zoning Ordinance states the following: <br />"Temporary buildings and/or Trailers: (Used for construction <br />purposes only) shall be removed upon completion or abandonment of <br />construction work. Temporary buildings and/or trailers cannot be <br />used as a place of residence." <br />Valcon II, Inc. had asked about the placement of a travel trailer for <br />living purposes on the new school site before they began the job. <br />They were advised that it was not permitted under the terms of the <br />ordinance. Subsequently the travel trailer was placed on the site <br />without a permit. This trailer was wired improperly and without a <br />permit. The City water main was tapped by the contractor without the <br />City's knowledge and without a meter. The latter two situations have <br />now been remedied. <br />Similar requests have been relatively common on the larger <br />construction jobs. All previous contractors have simply placed the <br />travel trailers in one of the several mobile home and RV parks within <br />the City. This request states that the unit is needed for security <br />purposes Monday through Friday and until noon on Saturday. There will <br />be someone living in the unit during these times. The question before <br />the Board is to decide whether or not the decision of the Building <br />Official is a correct interpretation of the ordinance. <br />RES~1~i~~~.~ <br />The section of the ordinance should be analyzed and a decision made as <br />to the validity of the Building Official's decision. If the <br />interpretation of the ordinance is correct then the appeal should be <br />denied. If the interpretation of the ordinance is incorrect then the <br />Board should overrule the decision of the Building Official. <br />
