® • <br />• <br />GRODA ENTERPRISES, INC. <br />• <br />• <br />Request: Special Exception Request ~dSE89-001 <br />Requested for: 1009 San Jacinto <br />Legal Description: Lots 4 & 5; Blk 305;~La Porte Tract <br />(see Exhibit A) <br />Zoning: R-3, High Density Residential <br />(see Exhibit B) <br />Annlicant: Groda Enterprises, Inc., Gary Groda, Owner <br />Background: <br />The applicant is requesting this special exception to allow <br />the expansion of an existing commercial building located in a R-3 <br />Zone. Ownership of buildings and property in this location is <br />somewhat complex. Mr. Groda owns lots 4 & 5 of this block ano" <br />the building located on it. This building is joined by means of <br />a covered breezetaay to the building on the adjoining property. <br />Both the Zoning Ordinance and building code consider these joined <br />structures to be a single building. <br />Although, Groda Enterprises occupies and utilize s• both <br />portions of the joined building, due to the fact that Mr. Groda <br />only owns lots 4 & 5, only these lots may be considered in this <br />request. <br />In addition to the 40 ft. X 40 ft. building located on these <br />lots, there is, .also a 12 ft. X 8 ft. portable storage building. <br />I~Ir. Groda is proposing a 40 ft. X 40 ft., 2 story addition to be <br />located on the front side of the existing primary structure (See <br />Exhibit A). <br />At the time of the existing building's construction, Zoning <br />Ordinance 4780 was in~..effect. This property was, at that time, <br />zoned for Commercial use and the existing building met all zoning <br />requirements. The building and use of the property (Groda <br />Enterprises has occupied this building since March 1984) were <br />rendered non-conforming with the adoption of Zoning Ordinance <br />~~1501 (January 26, 1987). <br />As it .is occupied by a non-conforming use, Mr. Groda's <br />building may only be enlarged if a Special Exception is granted <br />by the board. It is for this reason, Mr. Groda has requested a <br />Special Exception under the provisions of Section 11-605.2a. <br />
