® • <br />Special Exception Request 8g-001, Page 2 <br />• <br />Section 4-200 states: <br />"The general public, the Planning Commission and the Board <br />are directed to take note that non-conformities in the use <br />and development of land and buildings are to be avoided, or <br />eliminated where now existing, wherever and whenever <br />possible, er.cept when necessary to preserve property rights, <br />specific structures, lots, or uses established prior to tt~e <br />date these regulations became effective as to the property in <br />question, and when necessary to promote the general welfare <br />and to protect the character of surrounding property." <br />As noted earlier, both the existing building and its use <br />(sales and service of fire protection equipment) 'are <br />non-conforming. The building is non-conforming due to failure to <br />meet R-3 setback requirements. <br />Section 4-201 states: <br />"...no non-conforming structure shall be enlarged or extended <br />unless the enlargement or extension can be, and is, made in <br />• compliance with all of the provisions herein established for <br />structures in the district in which the non-conforming <br />structure is located." <br />Section 11-605.2 states: <br />"[to grant a special exception,] the Board [must find] that <br />such special exception will not adversely affect the value <br />and use of adjacent or neighboring property or be contrary to <br />the best public interest." <br />Section 11-60~ 2a continues: <br />"[A special exception to] enlarge or extend a building <br />occupied by a non-conforming use on the lot of record [may be <br />granted] provided that ~the...enlargement does not prevent the <br />return of the property to a conforming use." <br />Y1hen considering a special exception request, the Board must <br />use these ordinance sections as their guide. <br />Ana~sis: <br />• The two (2) lots which make up this tract are comprised of <br />6250 sq. ft. There is presently 1696 sq. ft. of structure on the <br />property. This constitutes a lot coverage of 27~. The proposed <br />addition would increase lot coverage to approximately 53~• <br />
