Staff Report January -24, 2002 <br />. Appeal of Building Official's Decision -#A 01-002 <br />Requested by: Gilbert R. Payne <br />BackEround: In late 1995, Gringo's Mexican Kitchen was completed and began serving <br />La Porte and surrounding communities. Since that time, business demands <br />have resulted in. two remodeling/additions -to the original restaurant. The <br />first remodel was in late 1997 and the more recent remodel/addition was <br />completed in June 2001. <br />Also, in May of 1999, Mr. Ybarra was responsible. for the development of a <br />new shopping center complex on the adjoining property known as 2627 <br />Underwood Road.. . <br />In August 2001, two sign permits were applied for and issued by the City. <br />The permits were for the original restaurant known as 2631 Underwood <br />Road. One permit was for a small sign 'to be mounted on the north side of <br />the building. The purpose of this sign was to identify the entrance to the new <br />"take-out order" area. A copy of that sign design follows this report and is <br />identified as "Exhibit A". <br />The second permit issued was for the installation of a new freestanding, on - <br />premise pole sign to replace the previous one located in front of the business <br />on Underwood Road. A copy of this sign design follows this report and is <br />identified as "Exhibit B". <br />Permits were issued and the signs have been installed. Their locations, size <br />or heights do not present a problem; however, both sign designs include <br />moving lights that does create a conflict with current city sign regulations. <br />Under zoning regulations, Sect. 106-871(b) of the City's Code of Ordinances <br />read as follows: <br />
