<br />CHARACTER, WHETHER REAL OR ASSERTED, ARISING OUT OF OR IN CONNECTION <br />WITH THE EXECUTION, PERFORMANCE, ATTEMPTED PERFORMANCE OR <br />NONPERFORMANCE OF THIS AGREEMENT OR THE OPERATIONS, ACTIVITIES AND <br />SERVICES OF THE PROGRAMS DESCRIBED HEREIN, WHETHER OR NOT CAUSED, IN <br />WHOLE OR IN PART, BY ALLEGED NEGLIGENCE OF OFFICERS, AGENTS, SERVANTS, <br />EMPLOYEES OF THE COUNTY. <br /> <br />CONTRACTOR LIKEWISE COVENANTS AND AGREES TO AND DOES HEREBY <br />INDEMNIFY AND HOLD HARMLESS THE COUNTY FROM AND AGAINST ANY AND ALL <br />INJURY, DAMAGE OR DESTRUCTION OF PROPERTY OF THE COUNTY, ARISING OUT <br />OF OR IN CONNECTION WITH ALL ACTS OR OMISSIONS OF ITS OFFICERS, <br />MEMBERS, AGENTS, EMPLOYEES, INVITEES, LICENSEES, OR PROGRAM <br />PARTICIPANTS, OR CAUSED, IN WHOLE OR IN PART, BY ALLEGED NEGLIGENCE OF <br />OFFICERS, AGENTS, SERVANTS, EMPLOYEES OF THE COUNTY. <br /> <br />C. Insurance and Bonding <br /> <br />1. Public Liability Insurance <br />La Porte agrees to require its Contractor/sub-Contractors to carry adequate Public Liability <br />Insurance in the amounts required by State law. The amounts of such insurance shall not be less <br />than the maximum liability that can be imposed on the County under the laws of the State of <br />Texas. At present, such amounts are as follows: <br /> <br />Bodily injury or death, per person $100,000 <br />Bodily injury or death, per occurrence $300,000 <br />Property damage, per occurrence $100,000 <br />La Porte understands that such insurance amounts shall be revised upward at the County <br />and that La Porte shall cause its Contractor to revise such amounts within thirty (30) days <br />following notice to La Porte of such requirements. <br />2. <br />La Porte shall cause its Contractor to furnish the County with a Certificate of Insurance as proof <br />that it has obtained and paid for a policy of Worker <br />required by State law, covering any and all employees active in the Program funded under this <br />Agreement. <br /> <br />Accordingly, if La Porte - <br />insurance, as provided by Texas Labor Code § 406.003, such documentation of self-insurance <br />shall be provided to the County prior to, or with the submission of, the first reimbursement <br />request. <br /> Page 12 of 58 <br /> <br />
