<br />the FTA 5307 Grant Program; <br />c. Records required to document the acquisition, improvement, use or disposition of <br />real property acquired or improved with FTA assistance; <br />d. Financial records as required by 49 U.S.C. 5307 and OMB Super Circular 2 CFR <br />Part 200; and <br /> <br />2. Retention <br />La Porte shall retain all records pertinent to expenditures incurred under this Agreement for a <br />period of six (6) years after the termination of all activities funded under this Agreement, or after <br />the resolution of all Federal audit findings, whichever occurs later. Records for non-expendable <br />property acquired with funds under this Agreement shall be retained for six (6) years after final <br />disposition of such property. <br />3. Construction Policies, Reports and Davis-Bacon and Related Acts Requirements <br />La Porte shall ensure that each contract subject to Federal (Davis-Bacon and Related Acts) labor <br />standards requirements must contain the appropriate contract provisions containing the labor <br />standards clauses described in Exhibit C, Section 13. These clauses correspond to the <br />Department of Labor (DOL) regulations prescribing the responsibilities of the Contractor and <br />obligating the Contractor to comply with the labor requirements. The labor standards clauses also <br />provide for remedies in the event of violations, including withholding from payments due to the <br />Contractor to ensure the payment of wages or liquidated damages, which may be found due. <br />La Porte shall ensure compliance with the Davis-Bacon and Related Acts (DBRA) requirements. <br />La Porte shall furnish or cause to furnish documents evidencing compliance with the DBRA <br />requirements, including but not be limited to the following: <br /> <br />a. Certified Weekly Payrolls <br />b. Certificate From Contractor Appointing Officer or Employee to Supervise Payment <br />of Employees <br />c. Posting of Equal Employment Opportunity Poster, Notice to Employees Poster and <br />Wage Decision(s) <br />d. Certificate for Contracts, Grants, Loans and Cooperative Agreements <br />e. General Contractor/ Subcontractor Profile <br />NOTE: All of the above listed documents pertaining to the DBRA are required to be <br />submitted by the prime Contractor, all Subcontractors and all third-tier subcontractors <br />without exceptions. <br />4. Deadlines <br /> <br />DBRA compliance documents shall be submitted during the course of project <br />construction pursuant to the deadlines in Exhibit C. <br /> <br /> Page 14 of 58 <br /> <br />
