PlanningandZoningCommissionRegularMeeting <br />July16,2015 <br />LegacyatLaPorteSCUP <br />Analysis: <br />Thereareanumberofdifferentconsiderationsstaffevaluatedduringthereviewofthis <br />application.ThefollowingdescribesƭƷğŅŅƭanalysisofthoseconsiderations: <br />LandUse. <br />ThisSCUPapplicationisforconsiderationoftheuseofthe6.95acretracttobeusedfor <br />multifamilydevelopment.ThesubjectpropertyiszonedPlannedUnitDevelopment, <br />PUD,whichallowsfortheproposeduseofthispropertysubjecttoapprovalofaSCUP. <br />AccordingtotheĭźƷǤƭfuturelandusemap,thesubjectsiteisdesignatedfor <br />ͻbĻźŭŷĬƚƩŷƚƚķ/ƚƒƒĻƩĭźğƌͼuses(seeExhibitE).ShouldthisSCUPbeapprovedforthe <br />proposedapartmentcommunity,thefuturelanduseplanwillneedtobeamended. <br />SuchrequestwillbeaseparateagendaitemforconsiderationbytheCommission.Ina <br />landusesense,multifamilyresidentialdevelopmentisalessintenselandusecategory <br />thancommercialuses. <br />Asameansofhistory,in2007aSCUPwasapprovedthatallowedforconstructionofa <br />nursinghomefacilityonthissite.ThisfacilitywasneverconstructedandtheSCUPis <br />nowinvalid. <br />SitePlan. <br />Theapplicanthassubmittedaconceptualsiteplanandaprojectdescriptionletter, <br />whichincludesphotographsofasimilardevelopmenttoprovideanexampleofwhatis <br />proposedatthissite.Atthistimetherehasbeennoformalapplicationforasite <br />developmentplanasrequiredintheĭźƷǤƭDevelopmentOrdinance.Aformalapplication <br />forasitedevelopmentplanisnotrequireduntilafteraSCUPisapproved.ShouldCity <br />CouncilapprovetheproposedSCUP,theapplicantwillberequiredtosubmitapplication <br />forasitedevelopmentplanincompliancewithapplicablecoderequirements.Staffis <br />recommendingaconditionthattheapplicantberequiredtosubmitthesiteplanfor <br />approvalbythePlanningandZoningCommission. <br />Density. <br />Theapplicantisproposingadensityof17.8297unitperacre.AccordingtoSection106 <br />333oftheCodeofOrdinances,multifamilydevelopmentisallowedonlyupto14 <br />dwellingunitsperacre.Theapplicantisproposinganincreasetothemaximumdensity <br />ofapproximately3.83unitsperacre.Thisdeviationtothecoderequirementscanonly <br />beapprovedthroughapprovalofavariancebytheBoardofAdjustment.Asaresult, <br />staffisrecommendingthataconditionbeincludedintheSCUPrequiringapplicationfor <br />avariancebeapprovedbytheboardbeforethisordinancegoesintoeffect.Shouldthe <br />Boarddenythevariance,thentheSCUPwillnotgointoeffect. <br />3 <br /> <br />
