AGREEMENT <br /> FOR HAZARDOUS MATERIALS EMERGENCY <br /> PREPAREDNESS (HMEP) PLANNING GRANT <br /> STATE OF TEXAS § <br /> COUNTY OF TRAVIS § <br /> PARTIES <br /> Pursuant to the authority of TEXAS GOVERNMENT CODE §§ 418.043 and 418.044 and /or § 791.011, <br /> this Agreement for a Hazardous Materials Emergency Preparedness Planning grant is made by and <br /> between the State of Texas, acting by and through the Texas Department of Public Safety (TX DPS), <br /> Texas Division of Emergency Management, hereinafter called the "STATE," and The City of La Porte <br /> hereinafter referred to as the "GRANTEE," serving as a fiscal agent for the La Porte, Morgan's Point, <br /> Shoreacres Local Emergency Planning Committee (LEPC). <br /> WITNESSETH <br /> WHEREAS, the STATE has no programmed resources to implement this requirement of federal law; and <br /> WHEREAS, the STATE will receive funds from the United States Department of Transportation (DOT) to <br /> accomplish the tasks detailed in this Agreement. <br /> AGREEMENT <br /> NOW, THEREFORE, the STATE and the GRANTEE in consideration of the mutual covenants and <br /> agreements contained herein, do mutually agree as follows: <br /> The GRANTEE agrees to perform hazardous materials emergency preparedness planning activities in <br /> connection with the project as stated in the Articles to follow and outlined hereafter, and for having <br /> rendered such services, the STATE agrees to pay to the GRANTEE compensation for these services as <br /> set out in this Agreement. All services performed under this Agreement shall be performed under the <br /> supervision of the Chief, Texas Division of Emergency Management (TDEM), represented by the HazMat <br /> Preparedness Officer as the STATE project officer. <br /> 1. CONTRACT PERIOD <br /> This Agreement shall become effective upon the date of final execution by the STATE and shall be <br /> completed by August 31, 2011 unless terminated in a manner defined herein. <br /> 2. SERVICES TO BE PROVIDED BY THE GRANTEE <br /> The GRANTEE shall: <br /> A. Complete the following project activities: <br /> Page 1 of 8 <br /> Contract Number 11- DEM -LEPC -001 <br />
