II. <br /> For and in consideration of the governmental services to be provided by LA PORTE <br /> to CITY, CITY agrees to pay LA PORTE on a monthly basis, regardless of whether LA <br /> PORTE Fire or EMS equipment or personnel respond to a call in CITY, as follows, to wit: <br /> (1) Monthly base charge as follows: <br /> Emergency 911 Dispatch and Jail Service $ 865.20 <br /> Fire Protection $ 2,279.28 <br /> Emergency Medical Service $ 1,863.12 <br /> Total $ 5,007.60 <br /> (2) A further sum of $ 8.00 per prisoner per day or any fraction thereof. The total of such <br /> base charges, including any accrued prisoner fees, shall be paid in full by CITY to LA <br /> PORTE, on or before the tenth day of the month following the month in which such services <br /> were available or rendered to CITY, under this agreement. Payments by CITY shall be made <br /> from current revenues available to CITY. <br /> 111. <br /> LA PORTE will not be liable for loss or damage to person or property arising from, <br /> caused by, or resulting from actual or alleged negligence of LA PORTE, its employees or <br /> volunteers in carrying out the terms of this agreement. To the extent allowed by law CITY <br /> agrees to indemnify, and save and hold LA PORTE harmless, from any such claim for loss or <br /> damage by itself, or by any person, firm, corporation, or association, in connection with this <br /> agreement. <br /> IV. <br /> Either party to this agreement may cancel by giving one hundred twenty (120) days <br /> written notice to the other party. Such notice will be effective as of midnight of the sixtieth <br /> day following the day notice is received by CITY or LA PORTE. <br /> V. <br /> CITY personnel shall abide by all LA PORTE rules, regulations, and policies, as they <br /> now exist, or may be amended hereafter, relating to the services rendered including the use of <br /> facilities made available to the CITY under the terms of this agreement. <br />
