PlanningandZoningCommissionRegularMeeting <br />July16,2015 <br />PortCrossingSCUP <br />interestandwelfareofthe <br />community. <br />ShouldthePlanningandZoningCommissionrecommendapprovaloftherequested <br />SCUPapplication,staffrecommendsthefollowingconditionsbeconsidered: <br />1.ThisSpecialConditionalUsePermit(SCUP)wouldbeapplicabletospecific <br />developmentanticipatedorproposedbytheGeneralPlan. <br />2.UsesareasdescribedintheLandUseExceptions(ExhibitCoftheAmended <br />DevelopmentAgreement). <br />3.ThisSCUPoutlinesingeneraltermstheproposedPlannedUnitDevelopment. <br />Thedeveloperrecognizesandunderstandsthatanyfutureconstructionor <br />developmentoftheprivateorpublicimprovementsanticipatedbythisSCUP <br />andtheGeneralPlanshallrequirefurthersubmittalandapprovalofspecial <br />conditionalusepermits,plats,siteplans,constructiondrawings,andbuilding <br />plans,etc.Inaddition,thisSCUPsupersedesSCUP#06006. <br />4.ThisSCUP,theGeneralPlan,RestrictiveCovenants,andLandUseExceptionsare <br />exhibitstoandareapartoftheAmendedDevelopmentAgreement. <br />5.SubmittalsshallbeinaccordancewiththisSCUP,GeneralPlan,Development <br />Agreement,RestrictiveCovenants,andLandUseExceptionsapprovedbythe <br />Cityof <br />LaPorteandspecificallySection106216&106217oftheCityofLa <br />PorteCodeofOrdinancesasitnowexistsormaybeamendedfromtimeto <br />time. <br />6.Thebusinessparkidentificationandentryfeaturesshallremainandbe <br />maintainedasconstructedunlessapprovedbytheCityCouncil. <br />7.TruckparkingonanylotfrontingStateHighway146willbeprohibitedonthe <br />eastsideofanystructure. <br />8.TheDevelopershallcomplywithallotherapplicablelawsandordinancesofthe <br />CityofLaPorteandtheStateofTexas.Totheextentthereisaconflictbetween <br />thoselawsandordinancesandthisSCUP,theSCUPcontrols. <br />9.ThisSCUPisbindingonallownersofpropertyincludedintheLegaldescription <br />andtheirsuccessorsandassigns. <br />\[AnyadditionalconditionsrequestedbythePlanningandZoningCommission.\] <br />4 <br /> <br />
