PlanningandZoningCommissionRegularMeeting <br />July16,2015 <br />PortCrossingSCUP <br />LandUse. <br />ThisSCUPapplicationisforconsiderationisintendedtocleanupanumberofissues <br />thataroseconcerninglanduse.InNovember2014theCityapprovedmodificationsto <br />theĭźƷǤƭZoningOrdinance(Chapter106)andspecificallypertainingtonotallow <br />warehousinganddistributionandtruckterminalusesintheBI,BusinessIndustrial, <br />District.TheintentofthePortCrossingBusinessParkwastoallowthoseuses.Thereis <br />nochangetothedevelopmentpatternorintensityoftheproposeddevelopment.City <br />CouncilhasdirectedstafftoworkwithPortCrossingrepresentativesonasolutionthat <br />wouldallowthoseuses.TheproposedSCUPwillincorporatearevisedGeneralPlan, <br />DevelopmentAgreement,andLandUseExceptions. <br />FutureDevelopment. <br />Futuredevelopmentwillstillrequireapprovalofindividual{/ <br />tƭͲsiteplans,platting <br />(asnecessary),andbuildingpermits. <br />PublicUtilities. <br />Publicutilityinfrastructurehasalreadybeeninstalledandacceptedbythecity. <br />Conclusion: <br />Basedontheanalysisabove,stafffindsthatifthePlanningandZoningCommission <br />desirestorecommendapprovaloftheproposedSpecialConditionalUsePermit,thena <br />numberofconditionsshouldbeconsideredintheapproval.Section106217ofthe <br />ZoningOrdinanceoutlinesspecificconditionsforapprovalofSCUPapplications.There <br />arethreedifferentconditionsthatmustbemetinordertoapproveaSCUP.The <br />followingtableidentifieseachofthethreeconditionsandƭƷğŅŅƭfindingoneach: <br />Condition: <br />StaffAnalysis: <br />(1)Thatthespecificusewillbe <br />TheproposedSCUPisintendedtoͻĭƌĻğƓǒƦͼwhatwasalready <br />compatiblewithandnot <br />approvedaspartofthepreviouslyapprovedSCUPforPortCrossing <br />injurioustotheuseand <br />(#06006).Thereisnointenttoincreasetheintensityofdevelopment <br />enjoymentofotherproperty, <br />fromwhatwasoriginallyapprovedinthepreviousSCUP,butis <br />norsignificantlydiminishor <br />intendedtocorrectdiscrepanciesbetweenthevariousdocuments <br />impairpropertyvalueswithin <br />governingdevelopmentofthissite. <br />theimmediatevicinity. <br />(2)Thattheconditionsplacedon <br />AsaconditionofapprovaloftheproposedSCUP,theapplicantis <br />suchuseasspecifiedineach <br />requiredtosubmitwithindividualdevelopmentaSCUP,site <br />districthavebeenmetbythe <br />developmentplanandbuildingconstructiondrawinginaccordance <br />applicant. <br />withtheĭźƷǤƭrequirements.Eachdevelopmentwillalsobesubjectto <br />thisSCUP,GeneralPlan,DevelopmentAgreementandLandUse <br />Exceptions. <br />(3)Thattheapplicanthasagreed <br />Theapplicantwillneedtoconfirmontherecordatthepublichearing <br />tomeetanyadditional <br />thattheyareagreeabletotheconditionsimposedontheSCUP.Staff <br />conditionsimposed,basedon <br />hasprovidedalistofconditionsaspartofthisreport.However,the <br />specificsiteconstraints,and <br />CommissionandCityCouncilmayimposeadditionalconditions. <br />necessarytoprotectthepublic <br />3 <br /> <br />
