PlanningandZoningCommissionRegularMeeting <br />June16,2016 <br />PriorityTowingSCUP <br />Section106217oftheZoningOrdinanceoutlinesspecificconditionsforapprovalof <br />SCUPapplications.Therearethreedifferentconditionsthatmustbemetinorderto <br />approveaSCUP.ThefollowingtableidentifieseachofthethreeconditionsandƭƷğŅŅ͸ƭ <br />findingoneach: <br />Condition:StaffAnalysis: <br />(1)ThatthespecificusewillbeStaffhasconcernswithlocatingatowingwreckeryardonSpencer <br />compatiblewithandnotHighwayandadjacenttofutureresidentialdevelopment.Theremay <br />injurioustotheuseandbeotherlocationszonedGC,wheresuchuseisnotimmediately <br />enjoymentofotherproperty,adjacenttoresidentialuses.However,iftheCommissiondesiresto <br />norsignificantlydiminishorrecommendapprovaloftheproposeddevelopment,thenstaff <br />impairpropertyvalueswithinrecommendsthattheapplicantberequiredtoplacean8foothigh <br />theimmediatevicinity.masonrywallalongtheentiresouthpropertylineadjacenttothe <br />futureresidentialuse. <br />(2)ThattheconditionsplacedonAsaconditionofapprovaloftheproposedSCUP,theapplicantis <br />suchuseasspecifiedineachrequiredtosubmitasitedevelopmentplaninaccordancewiththe <br />districthavebeenmetbytherequirementsoftheĭźƷǤ͸ƭDevelopmentOrdinance.Additionally,the <br />developmentplanwillneedtocomplywithallotherprovisionsof <br />applicant.site <br />theĭźƷǤ͸ƭZoningOrdinanceandwillbereviewedduringthesite <br />developmentreview. <br />(3)ThattheapplicanthasagreedTheapplicantwillneedtoconfirmontherecordatthepublichearing <br />tomeetanyadditionalthattheyareagreeabletotheconditionsimposedbytheSCUP.Staff <br />conditionsimposed,basedonhasprovidedalistofconditionsaspartofthisreport.However,the <br />specificsiteconstraints,andCommissionandCityCouncilmayremove,alter,orimposeadditional <br />necessarytoprotectthepublicconditions,shouldtheyapprovetheproposedSCUP. <br />interestandwelfareofthe <br />community. <br />ShouldthePlanningandZoningCommissionrecommendapprovaloftherequested <br />SCUPapplication,staffrecommendsthefollowingconditionsbeconsidered: <br />1.Asitedevelopmentplanshallbesubmittedinaccordancewithapplicable <br />requirementsoftheCityofLatƚƩƷĻ͸ƭDevelopmentOrdinanceandshall <br />complywithallprovisionsofChapter106,ͻœƚƓźƓŭͼofthe/źƷǤ͸ƭCodeof <br />Ordinancesandallotherdepartmentreviewsandapplicablelawsand <br />ordinancesoftheCityofLaPorteandtheStateofTexas. <br />2.Allsurfacingshallbedustfreeinaccordancewithcoderequirements. <br />Approveddustfreesurfacematerialincludesasphalt,concreteorchip <br />seal(TXDOT316Standard). <br />3.ThedeveloperwillberequiredtosubmitforapprovalbytheCity <br />Engineer,drainagecalculationsindicatinghowtheproposed <br />developmentwillaccommodatetherequirementsforstormwater <br />detentioninaccordancewiththeĭźƷǤ͸ƭPublicImprovementCriteria <br />Manual.Additionally,theapplicantshallprovideapprovalfromHarris <br />Countyastheprojectwilldischargeintotheirfacilities. <br />4 <br /> <br />
