Spencer Landing Subdiv. ~liminary Plat • <br />5/1/97 - P & Z Meeting <br />Page 2 of 3 <br />Upon submittal of the Section I Final Plat, the developer will be <br />responsible for providing covenants or deed restrictions.. Specific terms <br />of the covenants should include the following: <br />• Clear responsibility for maintenance of landscaping, screening, <br />fencing and undeveloped portions of property. <br />• Clear responsibility for maintenance of all stormwater drainage <br />systems located on site including swales, channels and detention <br />facilities. <br />• The funding mechanism to be used to provide for maintenance <br />items specified by covenants. <br />• A clear statement,s~ecifying the parties responsible for <br />administration and enforcement of convenants. <br />These covenants should be submitted for City review and comment. <br />They should not be released for recordation until such time as the City <br />deems them to be satisfactory in terms of form and content. No <br />building permit for the project should be approved or released until the <br />approved covenants have been filed for recordation with Harris <br />County Deed Records.. <br />Conclusion: Staff has reviewed the Spencer Landing, Section I Preliminary Plat and <br />found it complies with many of the requirements of the Development <br />Ordinance. A copy of the Section I Preliminary Plat Checklist follows this <br />report. Some issues remain; therefore, staff recommends that the <br />Preliminary Plat of Section I be "Conditionally Approved" at this time. <br />Conditional Approval by the Commission requires submission of an <br />amended Preliminary Plat and additional documentation as specified by the <br />Commission. As part of the Conditional Approval, the Commission <br />should require the developer's compliance with the list of items shown <br />prior to the submission of an "Amended" Preliminary Plat. The <br />following items should be addressed: <br />1) Amend the Preliminary Plat as per checklist. <br />2) Delete reference to proposed 8" sanitary sewer in the utility easement <br />of Block 2. <br />
