Council continued the public hearing <br />on 1307 E. Main at multiple meeting dates to accommodate the probate process and subsequent <br />sale of the property to a prospective buyer. Subsequent to the first public hearing meeting, legal <br />notices in accordance with Article VIII; Section 82 -475 of the Code of Ordinance, were provided <br />to the structure owner. In addition, the individual attended the last public hearing and is aware of <br />the continuance. To keep the individual informed, staff has left phone messages and provided <br />meeting reminder letters via regular mail. <br />The property owner is deceased; however, a son has been handling the probate of the property. <br />At the October 10 meeting, the son advised Council the probate is complete and the potential <br />buyer (who was also at the meeting) is still interested in the property. The public hearing date <br />was continued for 30 -days to provide time for scheduling a closing on the property sale. <br />At the time of the agenda preparation, the owner's son had not provided staff with a closing date. <br />A condemnation ordinance has been prepared to allow Council flexibility of condemnation <br />versus continuance of the public hearing. <br />Action Required by Council: <br />Consider passage of ordinance or other action regarding condemnation of the substandard <br />building at 1307 E.
