CITYOFLAPORTEPARKSANDRECREATIONDEPARTMENT <br />INDEPENDENTCONTRACTORAGREEMENTFOR <br />FIVEPOINTSMARKETPROGRAM <br />Thisagreementmadeandenteredintoon___dayof,2012byandbetweentheCityofLa <br />Porte,TexasbyandthroughtheParksandRecreationDepartment,hereinafterreferredtoas“City”,and <br />__Mr.RobinRollinsandMrs.LetishaRollinswhoseaddressis3014BayouDrive, <br />___LaPorte_,Texas,77571__,hereinafterreferredtoas“INDEPENDENTCONTRACTOR”. <br />WITNESSETH: <br />ThisAgreementforuseofCityofLaPorteFivePointsTownPlazaisenteredintoinordertoexpressa <br />clearunderstandingofeachentity’srolesandresponsibilities. <br />TheCityofLaPorte“CITY”operatesFivePointsTownPlaza.ThisAgreementwithRobinRollins <br />andLeticiaRollins,“INDEPENDENTCONTRACTOR”,authorizesINDEPENDENT <br />MarketatFivePoints <br />CONTRACTORtoadministerandbetheproprietoroftheeventattheFive <br />PointsTownPlaza,onthefirstSaturdayofeverymonthfallingwithinthecontracttermperiodherein <br />. <br />providedThatinconsiderationofthemutualagreementshereincontained,theCITYherebyleasesto <br />theINDEPENDENTCONTRACTORandtheINDEPENDENTCONTRACTORherebyaccepts, <br />subjecttothetermsandconditionshereinsetforth,thepropertyknownastheFivePointsTownPlaza, <br />asmorespecificallyprovidedbelow: <br />1.Compensation.InfullconsiderationfortheperformanceoftheServicehereunder,andforany <br />rightsgrantedorrelinquishedbytheINDEPENDENTCONTRACTORunderthisAgreement, <br />theINDEPENDENTCONTRACTORshallpayCITYasfollows: <br />A.AllcostsoftheservicesprovidedfortheMarketDaysofLaPortemonthlyeventwillbe <br />bornesolelybytheINDEPENDENTCONTRACTOR.Nofeeorpaymentwillbeprovided <br />toCITYbysaidINDEPENDENTCONTRACTOR.Inlieuoffeeorpayment, <br />INDEPENDENTCONTRACTORagreestoprovidethree(3)boothspacesperevent,for <br />usebyCITYasfollows:one(1)boothspaceforgeneralCITYuse,one(1)boothspacefor <br />usebythePoliceorFireDepartment,andone(1)boothspaceforusebytheLaPorte <br />IndependentSchoolDistrict. <br />B.INDEPENDENTCONTRACTORacknowledgesandagreesthatitshallnotbeentitledto, <br />andCITYshallnotbeobligatedtopay,anymoniesorothercompensationfortheservices <br />providedandrightsgrantedunderthisAgreement. <br />2.Terms. <br />A.ThetermofthisAgreementshallcommenceonthefirstSaturdayinApril,2012and <br />includethefirstSaturdayofeachsubsequentmonththroughandincludingthefirst <br />SaturdayinOctober,2012,onatrialbasis.Attheendofthistrialperiod,CITYand <br />INDEPENDENTCONTRACTOR,bywrittenconsentofbothparties,mayextendthe <br />contractforthree(3)additionalone(1)yearrenewableoptions.Setuptimefortheevent(s) <br />1 <br /> <br />
