The proposed pipeline <br />originates in Webster, Texas and will terminate in Baytown.Right-of-Way crossings within La <br />Porte occur at Fairmont Parkway,Spencer Highway,North “D” Street,North “H” Street, North <br />“L” Street, North “P” Street, and State Highway 225 (See Exhibit 3).HSC’sapplicationmeets all <br />requirements of the Pipeline Transportation Ordinance(see Exhibit 4) and the company has <br />submitted all required documentation and fees per the ordinance. <br />Based on its review of HSC’sapplicationand construction plans, Staff anticipatesnoconflicts <br />between this pipeline and existing and proposed utilities, roads ordrainage ways. <br />Conditional to issuance of thispermit arethe following stipulations: <br />1.Attend pre-construction meeting with City Staff no less than 48 hours prior to <br />commencement of construction. <br />2.Post copies of this Permit at all public right-of-way crossings. <br />3.Per Sec. 102-235, Item (k) of La Porte’s Code of Ordinances (Ord. 2004-2755): “the <br />Permittee shall, at any time in the future, where such pipeline or portion thereof crosses <br />or is laid within, under or across any street, road or utility right-of-way, drainage way or <br />public way existing or projected at the time the permit is issued, reposition such pipeline <br />(which shall include lowering or raising the pipeline, as well as casing it, if required) at <br />the Permittee’s sole expense, when the City reasonably requires such action incidental to <br />public construction or public improvement: construction, maintenance and improvement <br />of streets, water lines, sanitary sewer lines, storm sewers, ditches and public utilities.The <br />City shall give the Permittee prior written notice of the need for repositioning location, <br />and such notice shall be mailed certified mail, return receipt requested, to the Permittee as <br />designated in the application. The Permittee shall have six (6) months to complete such <br />repositioning. <br /> <br />
