DISCUSSION <br />Location: <br />The subject site is located at the 3900 Block of Underwood Rd. <br />Legal Description: <br />Tracts 813 & N 300 feet of Lots 698 & 699; Tracts 698A, 699A & 814; Tracts 698B, 699B & 815 <br />La Porte Outlots, Harris County, Texas <br />Background Information: <br />The property is currently developed with a commercial business located on the southern third of <br />the site. The remaining two thirds is undeveloped. The Commission determined that due to the <br />existing commercial development and the character of the surrounding neighborhood, the <br />property should be rezoned from Medium Density Residential (R-2) and Low Density Residential <br />(R-1) to Planned Unit Development (PUD). This will allow for the possibility of the commercial <br />business to continue and expand if requested while allowing for the Commission and City Council <br />to put in place certain mitigation measures to ensure minimal impacts to the surrounding <br />residential developments. <br />The attached Exhibit B shows the zoning of the subject property and surrounding properties. In accordance with state law, notice of the public <br />hearing was also posted at City Hall and on the City's website. <br />Analysis: <br />Staff evaluated land use, access and utility considerations during the review of this application. <br />The following describes staff's analysis: <br />1. Land Use. Staff finds that the PUD zoning will allow for the most flexibility while still <br />protecting the surrounding residential uses. <br />2. Access. There is sufficient existing right-of-way access from Underwood Rd. <br />EN <br />
