Results of recall election. <br />If a majority of the votes cast at a recall election shall be <br />against the recall of the officer named on the ballot, he- shall <br />continue in. office for the remainder of his unexpired term, <br />subject to recall as before. If a majority of the votes at- such <br />an election be for the recall of the officer named on the <br />ballot, he shall, regardless of .any technical defects in the <br />recall petition, be deemed removed from office and the vV <br />cancy shall be filled by the commission as in other vacancies. <br />Section 106. Limitations on recalls. <br />No recall petition shall be filed against the mayor or 'a <br />commissioner within six (6) months after he takes office nor <br />in respect to an officer subjected to a recall election and not <br />removed thereby, until at least six (6). 'months after such <br />election. <br />tion 07. District judge may order election. <br />ould the commission fail or refuse to order any of. the <br />elections as provided for in this article, when all the require- <br />ments for such election have been complied with by the peti- <br />tioning electors in conformity with this article of the charter, <br />then it shall be the' duty of any one of the district judges <br />of Harris County, Texas, upon proper application being made <br />therefor, to order such elections and to enforce the carrying <br />into effect of -the provisions of this article of the .charter. <br />Article XI. Franchises and Public Utilities <br />Section 108. Powers of the city. <br />In addition to the city's power to buy, own, construct, main- <br />tain, and operate utilities and to manufacture and distribute <br />electricity, gas; or anything else that may be needed or used <br />by the public, the city shall- have further powers as may now <br />or hereafter be granted under the constitution and laws of. <br />the State of Texas. <br />Section 109. Franchises; power of commission. <br />The commission shall have power by ordinance to grant, <br />amend, renew and extend all franchises of all. public utilities <br />of every character operating within the City' .of La Porte, <br />.and for such purposes' is granted full power. All ordinances <br />granting, amending, renewing, or extending franchises for <br />public utilities not be finally passed until thirty j80) days <br />after the first reading; and no such ordinance shall take effect <br />until sixty (60) days after its final passage; and pending <br />such time, the full text of such ordinance shall bepublished <br />once each week for four (4) consecutive weeks in the official <br />newspaper of the City of La Porte, and the expense of such <br />publication shall be borne by the proponent of the franchise. <br />'No public. utility franchise shall be transferable except with . <br />the approval of the commission expressed by, ordinance. <br />Section 103. recall election. <br />The city clerk shall at once examine the recall petition and <br />if he finds it sufficient and in compliance with the provisions <br />of this article of the charter, he shall within five (5) days <br />submit it to the commission with his certificate to that effect <br />and notify the officer sought to be recalled of such action. <br />If the officer whose removal is sought does not resign within <br />five (6) days after such notice the commission shall thereupon <br />order and fix a date for holding a recall election. Any such <br />election shall be held not less than thirty (30) days nor more <br />than sixty (60) days after the petition has been presented <br />to the commission at the same time as any municipal election <br />held within such Period; but if no such municipal election <br />be held within such period, the commission shall calla special <br />election to be held within the time .aforesaid. <br />Section 104. ;Ballots in recall election. <br />Ulots used at. recall elections shall conform t6 theIdlow <br />
