Day <br />City Attorney <br />City Hall <br />Houston, Texas 77002 <br />Dear Mr. Day: <br />• This will confirm my recent discussion with <br />.you concerning the Lighting Company's proposed con- <br />struction of a pipeline system to transport oil to its <br />power plants. <br />As you will recall, we wrote you a letter con- <br />cerning this matter on May 21, a copy of which is en- <br />closed for your convenience. In our letter, we advised <br />you of our opinion that the pipeline is authorized by <br />the present franchise and that for that reason, among <br />ting Company is not required�to obtain <br />others, the Ligh <br />another franchise from the City for such pipeline which <br />is to be constructed across streets within the City. <br />We understand that the Public Works Department has <br />approved the plans and specifications for the crossings <br />but has sought an'opinion from, you on the franchise <br />question. In view of the pendency of other matters, <br />we have not had an opportunity to discuss this matter <br />in any detail. However, as I.explained in our recent <br />discussions, it is imperative that the Lighting Com- <br />pany let a contract for the construction of the pipeline. <br />
