Section 4. Suspension <br />• In the interest of good discipline, a director may suspend <br />an employee without pay for up to one week in one calendar year. <br />All suspensions in excess of one week must be approved by the <br />City Administrator. A written notice of suspension must be given <br />to the employee which describes the deficiency or infraction in- <br />volved, the terms of the suspension, and the likely consequences <br />of further unsatisfactory performance and/or conduct. The sus- <br />pension shall be permanently noted in the employee's official <br />personnel file. <br />When an employee is under investigation for a crime or of- <br />ficial misconduct or is awaiting hearing or trial in a criminal <br />matter, he or she may be suspended without pay for the duration <br />of the proceedings when such suspension would be in the best <br />interests of the' City and the public. If the investigation or <br />proceedings clear the employee, he or she shall be eligible for <br />reinstatement under such terms and conditions as may be specified <br />by the City Administrator. <br />Section 5. Demotion <br />In the interest of good discipline, an employee may be <br />demoted. A written notice of demotion must be given to the em- <br />• ployee which describes the deficiency or infraction involved and <br />which states the likely consequences of further unsatisfactory <br />performance and/or conduct. The demotion shall be permanently <br />noted in the employee's official personnel file, but the employee <br />shall not be disqualified from consideration for later advancement. <br />Section 6. Dismissal <br />In the interest of good discipline, an employee may be dis- <br />missed from the City service. A notice of dismissal must be given <br />to the employee which describes the deficiency or infraction involved. <br />Any employee who is dismissed for-just cause shall forfeit all <br />rights to any unused vacation, sick leave, or other benefits gener- <br />a11y received from the City. <br />Section 7. Appeal of Disciplinary Action <br />Formal disciplinary action taken under this chapter may be <br />appealed in writing directly to the City Administrator within <br />five (5) working days following notice of the action. The action <br />may be stayed .pending decision on the appeal or may take effect <br />at any time after issuance of the notice as determined by the <br />City Administrator. <br />• _ <br />24 <br />
