• <br />• 1. Payment on the lump sum fee shall be made for the <br />separate phases upon completion as follows: <br />a. Completion of Horizontal and Vertical <br />Ground Control, Aerial Photography and Contact <br />Prints submitted to CITY ... $10,300.00 <br />b. Completion of Aerial Mapping with <br />copy of paper manuscripts submitted to CITY ... $12,000.00 <br />c. Final Topographic Maps on mylar <br />submitted to CITY ... $12,000.00 <br />d. Completion of DRAINAGE STUDY and <br />submitted to CITY ... $11,400.00 <br />Approximately Eight Months will be required to complete the <br />DRAINAGE STUDY. <br />GENERAL CONSIDERATIONS <br />A. ARBITRATION. <br />• 1. All claims, disputes and other matters in question <br />arising out of, or relating to, this Agre~nrent or the breach <br />thereof shall be decided by arbitration in accordance with the <br />Construction Industry Aribration Rules of the American Arbitration <br />Association then obtaining. This agreement so to arbitrate shall <br />be specifically enforceable under the prevailing arbitration law. <br />2. Notice of the demand for arbitration shall be filed <br />in writing with the other party to this Agreement and with the <br />American Arbitration Association. The demand shall be made <br />within a reasonable time after the claim, dispute or other matter <br />in question has arisen. In no event shall the demand for <br />arbitration be made after the time when institution of legal or <br />equitable proceedings based on such claim, dispute or other <br />matter in question would be barred by the applicable statute of <br />limitations. <br />3. The award rendered by the arbitrators shall be final, <br />and judgment may be entered upon it in any court having juris- <br />diction thereof. <br />B. INSURANCE. <br />The ENGINEER will secure and maintain such insurance as <br />will protect him from claims under workmen's compensation acts, <br />• <br />
