<br />e <br /> <br />e <br /> <br />ORDINANCE NO. 1501 <br /> <br />AN ORDINANCE CONTAINING FINDINGS OF FACT AND DIRECTIVES TO THE PLANNING <br />COMMISSION: AND ADOPTING A NEW ZONING ORDINANCE FOR THE CITY OF LA <br />PORTE, SAID NEW ZONING ORDINANCE TO REGULATE: THE LOCATION AND USES <br />OF BUILDINGS, STRUCTURES, LAND, LOTS, AND USES AS DEFINED: THE HEIGHT <br />AND SIZE OF BUILDINGS, STRUCTURES, AND USES BOTH PRIMARY AND ACCESSORY: <br />THE DENSITY AND INTENSITY OF POPULATION AND USES, BOTH PRIMARY AND <br />ACCESSORY: THE SIZE AND LOCATION OF YARDS, SETBACKS, CONSERVATION <br />AREAS, AND OPEN SPACES: THE LOCATION AND DENSITY OF PARKING, LOADING, <br />EXTERIOR STORAGE, FENCING, AND LANDSCAPING: PROVIDING FOR PLANNED <br />UNIT DEVELOPMENTS: PROVIDING A SPECIAL CONDITIONAL USE PROCEDURE: RE- <br />ESTABLISHING A PLANNING AND ZONING COMMISSION AND A BOARD OF ADJUSTMENT: <br />AND PROVIDING FOR THE ADMINISTRATION AND ENFORCEMENT OF THIS ORDINANCE: <br />FOR SAID PURPOSES DIVIDING THE MUNICIPALITY INTO DISTRICTS OF SUCH <br />NUMBER AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE <br />REGULATIONS: PROVIDING THAT ANY PERSON, FIRM, OR CORPORATION VIOLATING <br />ANY OF THE TERMS OR PROVISIONS OF THIS ORDINANCE SHALL BE DEEMED <br />GUILTY OF A MISDEMEANOR, AND UPON CONVICTION SHALL BE LIABLE TO FINE <br />NOT TO EXCEED ONE THOUSAND DOLLARS ($1,000.00): WITH EACH DAY OF <br />VIOLATION CONSTITUTING A SEPARATE OFFENSE: PROVIDING A SAVINGS CLAUSE: <br />PROVIDING A SEVERABILITY CLAUSE: PROVIDING FOR THE REPEAL OF ALL <br />ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THE PROVISIONS <br />HEREOF AS OF THE EFFECTIVE DATE OF THIS ORDINANCE: AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: <br /> <br />The City Council of the City of La Porte makes the following <br /> <br />findings of fact: <br /> <br />(a) The Zoning Ordinance attached to this orainance as Exhibit <br />IIDII comprises only the text of the Zoning Ordinance of the <br />City of La Porte: <br /> <br />(b) The City Council of the City of La Porte acknowledges that <br />the official Land Use Plan and Zoning Map referred to in <br />Section 2-100 et. seq. of Exhibit IIDII is as yet to be adopted <br />by the Planning Commission and is as yet to be reported <br />and recommended to the City Council of the City of La Porte <br />by the Planning Commission: <br /> <br />(c) It is anticipated by the City Council of the City of La <br />Porte that the Land Use Plan and Zoning Map will be adopted <br />by separate ordinance of the City Council, with due notice <br />given and hearings held as required by law, by an ordinance <br />to be effective on the first day of January, 1987, said <br />ordinance to incorporate the provisions of this ordinance <br />by reference, with both ordinances becoming fully effective <br />and competent simultaneously on the first day of January, <br />1987. <br /> <br />The City Council of the City of La Porte hereby directs the <br /> <br />Planning Commission of the City of La Porte to expeditiously undertake <br /> <br />a review of the Land Use Plan and Zoning Map referred to in Section <br /> <br />2-100 et seq of the Zoning Ordinance, and to report their findings <br /> <br />and make a recommendation of the Land Use Plan and Zoning Map to be <br /> <br />adopted by the City Council on or before September 1, 1986. <br />
