"
o Appraisal obtained by applicant.
o The property was appraised in
unencumbered fee simple title, surface
rights only.

o Consent of City's franchised utilities
was required.

When "K" Street was closed for the Post
Office, the City reta ined easements and
included similar cond it ions des igned to
protect and maintain utilities. Since
the U.S. Post Office is a Government
Agency. No application or closing fee
was required.

Little Cedar Bayou which is adjacent to
the site" i's designated as a conservation
area. A mInImum landscape setback. of
t;wentT',(20') is required .adjacent to all
'designated conservation areas. These
ar"eas are" to"'be landscape'd'with trees,
shrubs, and groundcover. There is the
potential to utilize the . conservation
setback as an attraction for the
restaurant. This area might become a
positive attraction, outdoor eating, etc.
for the restaurant. In return,
McDonald's might assume responsibility
for the landscaping. This could relieve
Harris County and the City of La Porte of
this burden while preserving the spirit
and intent of the conservation area. In
addition the extension of pedestrian
trails envisioned by the Comprehensive
Plan could be accomplished. This idea
has been discussed with the
representative of McDonald's. Perhaps
the 8' -1 0' of flood control right-of-way
could be landscaped along with
approximately 10' of the alley way, with
McDonald's assuming responsibility for
maintenance of these items.

Sidewalks along Fairmont Parkway will be
required as per the Development Ordinance
and the Comprehensive Plan.
