I. <br />The City shall prepare plans and specifications for the hike and <br />bike trail and shall submit same to the District for approval. When the <br />District has approved the aforesaid plans and specifications, the City shall <br />construct said hike and bike trail on the District's lands described <br />hereinafter in accordance with the plans and specifications approved by the <br />District and in accordance with the provisions of this Agreement. If any <br />conflict arises between the provisions of the plans and specifications and <br />the provisions of this Agreement, the Agreement shall be controlling and <br />binding upon the parties hereto. It is expressly understood and agreed by <br />the parties hereto that the District does not have any funds specifically <br />allocated to the performance of its obligations under this Agreement and <br />nothing contained herein shall place any obligation upon the District to <br />appropriate any funds for any of the purposes expressed herein. It is <br />contemplated by the parties hereto that the the City shall complete the <br />construction of the hike and bike trail using its own equipment, personnel, <br />and materials. <br />II. <br />The District hereby authorizes the City to use the following <br />described lands situated in the County of Harris, State of Texas, for the <br />purpose of constructing and maintaining a public hike and bike path on <br />Harris County Flood Control District Unit F216-00-00, as shown in Exhibit <br />"A" attached hereto. <br />-Page 2- <br />
