The City shall maintain in good repair the hike and bike path <br />following its construction, including but not limited to the repair of any <br />pavement thereon and the City's said obligation to repair and maintain, <br />however, shall be limited to that required by ordinary wear and tear. The <br />City will mow the grass between the path where constructed and the <br />District's right-of-way line on the side of F216-00-00 on which the path is <br />constructed, and also between the path and the top of the bank on the side <br />of F216-00-00. The City agrees to mow the said grass at such time intervals <br />so as to keep same from attaining a height of more than nine (9) inches. <br />The District will continue to maintain and mow the sloped sides and basin of <br />F216-00-00 and will continue to treat such areas with chemical defoliant; <br />however, nothing herein shall require the District to appropriate or certify <br />as available any additional funds for this or any other purpose. After the <br />hike and bike path is constructed, the City will pick up the trash, paper, <br />and debris on the path and the said grass regularly. The City further <br />agrees to install and maintain appropriate traffic control signs along the <br />public hike and bike path, as deemed necessary or desirable by the District <br />for the safety of the users of the said path. <br />IV. <br />The City shall not undertake any alterations of existing <br />improvements upon the public hike and bike path without first securing the <br />written approval of the District of the plans and specifications for the <br />same. <br />-Page 3- <br />
