Council Meeting of~ptember 9, 1991 <br />Outline for Discussion of Workshop Item #11 <br />Page 2 <br />Code of Ordinances Chapter 3 Section 3-13 <br />"It shall be unlawful for any person to manufacture, brew, distill, <br />sell or distribute any wine, beer, liquor or other alcoholic <br />beverage within the city, or to engage in any other activity for <br />which a license or permit is required by the Texas Liquor <br />Control Act, without first obtaining a license so to do from the <br />~~ <br />city. <br />The annual fee is equal to 1 /2 the fee charged by the State for the <br />license. (Note: State law allows a municipality to charge up to 1 /2 <br />the fee collected by the State.) <br />~ 50/ <br />Ordinance -Zoning Ordinance <br />The ~ s zoning ordinance establishes the zoning districts in <br />which the manufacturing, selling, or distribution of alcoholic <br />beverages is permissible. <br />Based on meeting with Knox Askins and Cherie Black it is my <br />understanding that the local regulations listed above apply to all <br />permits issued by the A.B.C.. <br />****************************************************************************** <br />In addition La Porte further regulates the issuance of permits for on- <br />premises consumption of beer and wine. <br />Ordinance 1000 (and amendments) <br />Ordinance 1000 passed August 1974 established the locations <br />of existing establishments engaged in the sale of beer for <br />consumption on premise. <br />The ordinance by legal description designated the locations <br />where beer for consumption on premises may be sold and <br />prohibited the sale of beer for consumption on premises <br />elsewhere. <br />Amendments to Ordinance 1000 (Ordinance 1000A -BB) <br />have permitted on a case by case basis on premise <br />consumption of beer and wine. <br />The current policy and language used in ordinances amending <br />Ordinance 1000 call for a business to have: <br />"At leasixty-five (65) percent of the gross income shall <br />be derived from the sale of prepared food." <br />
