k ~. r ~ • <br />Several years ago the City of La Porte passed a comprehensive <br />zoning plan for the City and this paticular tract was zoned <br />Planned Unit Development, yet there is no infrastructure in place <br />for development of any nature. The zoning designation PUD over <br />the entire portion of this tract has adversely affected the <br />marketability of the property ,due to the fact that the tract has <br />over 1 mile of rail frontage which is normally associated with <br />heavy industrial users. Many industrial users shy away from <br />attempting to fight the City of Laporte on Zoning issues. <br />Last year the owners of this tract, spent money surveying and <br />dedicating a 100 foot wide drainage easement on the south end of <br />this parcel and neither Harris County or the City of La Porte has <br />expressed any interest in assisting the landowners in getting the <br />drainage right of way functional, to facilitate development of <br />the area. The Texas Legislature has passed laws addressing the <br />specific obligations of Municipalities when annexing a tract of <br />land and one of obligations is to provide utilities to the <br />property within three years. The City of La Porte has had <br />eighteen years to provide utilities to this tract and has not <br />done so, my advice to these landowners is to ask the City to be <br />de-annexed since the City is not providing any services or <br />utilities for the City Taxes that are being paid on the property. <br />In years past I have had Game Wardens and La Porte Police <br />officers hunting on this lease which further insured against <br />anyone trespassing and now the City Council has made it illegal <br />for me to allow them to hunt anymore. <br />Since the ordinance only speaks to game animals as defined by <br />the Texas Parks and Wildlife Code ", does the City Council have <br />any objections to my stocking the property with Mouflon Rams and <br />Barbadoau Sheep? <br />The Texas Legislature several years ago struck down a law that <br />made it illegal to hunt in the City Limits as unconstitutional. <br />Deer hunting in Texas is Big Business and with the stroke of a <br />pen, La Porte's City Council took away a valuable source of <br />income for me, from this property. I am hereby humbly requesting <br />that the City Council Grandfather my hunting rights on this <br />property, since it poses no threat to Public Health or Safety and <br />there is no anticipated development of the property, until the <br />drainage and infrastructure problems are resolved. <br />Respectful yo rs, <br />s h W.
