,~. r <br />RESOLUTION NO. 91- 12 <br />A RESOLUTION CONCERNING PERMITS FOR RETAILERS SELLING BEER AND WINE <br />FOR CONSUMPTION ON PREMISES, AT GASOLINE SERVICE STATIONS AND <br />GROCERY STORES, OR A COMBINATION TEiEREOF; FINDING COMPLIANCE WITH <br />THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LA PORTEt <br />Section 1. The City Commission of the City of La Porte, on <br />August 19, 1974, adopted City of La Porte Ordinance No. 1000, <br />designating the areas where beer and wine for consumption on <br />premises may be sold in the City of La Porte, and prohibiting the <br />sale elsewhere. Subsequent to the adoption of Ordinance No. 1000, <br />the City Council of the City of La Porte has issued permits for <br />retailers selling beer and wine for consumption on premises, only to <br />restaurants deriving at least 65$ of their gross income from the <br />sale of prepared food, and serving beer as a beverage only in <br />connection with the service of prepared food to a customer. <br />Section 2. By adoption of this Resolution, the City Council of <br />the City of La Porte confirms its existing policy. Without limiting <br />the generality of the foregoing, the City Council of the City of La <br />Porte establishes and reaffirms its policy under Ordinance No. 1000, <br />that City of La Porte permits for a retailer selling beer and wine <br />for consumption on premises, will not be issued to gasoline service <br />stations, grocery stores, or combination gasoline service station - <br />grocery store businesses. <br />Section 3. The City Council officially finds, determines, <br />recites and declares that a sufficient written notice of the date, <br />hour, place and subject of this meeting of the City Council was <br />posted at a place convenient to the public at the City Eiall of the <br />City of La Porte, Texas for the time required by law preceding this <br />meeting, as required by the Open Meetings Law, Article 6252-17, <br />Texas Revised Civil Statutes Annotated; and that this meeting has <br />been open to the public as required by law at all times during which <br />this resolution and the subject matter thereof has been discussed, <br />considered and formally acted upon. The City Council further <br />ratifies, approves and confirms such written notice and the contents <br />and posting thereof. <br />
