As I also discussed with <br /> you, a portion of the property abutting on the street and alley <br /> requested to be abandoned are not currently owned by our client~ <br /> rather, our client has contracted to purchase these properties and <br /> copies of the purchase agreements executed in connection therewith <br /> and the commitments for title insurance issued pursuant thereto are <br /> enclosed herewith. <br /> It is my understanding from our discussion that the City can <br /> proceed with the application for purposes of issuing a policy <br /> determination which would indicate whether the abandonment request <br /> would be granted or not and that upon closing of the purchase of <br /> the remaining properties abutting on the street and alley, our <br /> client can then proceed with the street and alley closing on a pre- <br /> approved basis. Accordingly, the enclosed application is submitted <br /> to you for purposes of obtaining a policy determination with the <br /> understanding that our client will execute and deliver to you the <br /> necessary written consent and waiver of claim form and the street <br /> and alley closing application within the next few days. <br /> I have also enclosed the following: <br /> 1- two ( 2 ) copies of a plat of the street and alley to be <br /> abandoned prepared by R. M. Atkinson, Jr. , Engineers, <br /> Inc . ~ <br />
