As proposed, Ordinance 1000-1 is a revision and replacement of <br />La Pone's on-premises Wine and/or Beer Ordinances 1000 thru 1000-HH. The following is a <br />summary of the proposed Ordinance 1000-1. <br /> <br />The initial goal was a tightening of the coordination clause between the City's Wine and/or Beer <br />Ordinance, Zoning Ordinance, and the Texas Alcoholic Beverage Code. The question has been <br />raised in the past as to whether or not a wine and/or beer license issued by Ordinance 1000 <br />supersedes the applicability of the City's Zoning Ordinance. Tightening of the language in <br />Section 6 of the Ordinance should address that concern. It should be clear that for an individual <br />to legally sell wine and/or beer for consumption on-premises within the City of La Pone, the <br />property must be: 1) properly zoned; 2) properly licensed and permitted pursuant to the Wine <br />and/or Beer Ordinance; and 3) meet all provisions of the Texas Alcoholic Beverage Code. <br /> <br />The second change made is the locations permitted to sell wine and/or beer on-premises within <br />the City have been updated to reflect all currently existing license locations. Locations that have <br />gone out of business are no longer included in the Ordinance's listing. Additionally, Section 2 <br />of the Ordinance provides much more detailed information to the City in connection with the <br />owner of the property, the street address and legal description of the property, the trade name <br />or business name of the applicant, and the name and descriptive information in connection with <br />the applicant for each City of La Pone license. <br /> <br />EXHlsrr A <br />
